Final response received from Creation Finance - advice required please

Hi,
I received a final response from Creation today who I have had a storecard with since 2001. They have sent me a copy of the original credit agreement which has my signature on there and the PPI box is ticked. However, the form has not been completed by me, nor was it me who ticked the boxes but the signature is mine. The storecard was applied for in store so it must have been the representative who actually completed the form but I do not believe that I would have requested PPI.
Creation have said that as there is a clear tick in the box I requested PPI and they have said that it has been included on my statements since 2001 and that I coulld have cancelled it at any time but didnt.
I would really appreciate some advice on whether the next stage would be to write to FOS and whether you think that I have a case given they have a signed credit agreement with a tick in the box.

Unless you mean Creation Consumer Finance Limited of Belfast, I would say you stand virtually no chance.
No other firm that has ever traded under that name is subject to FOS jurisdiction.
Even if it was, if the sale took place before mid 2001 it would not have jurisdiction.
Even then, the argument that payments were taken for 10 years and detailed on your statements but you did not complain would allow them to time bar your complaint now.0 -

Thanks for taking the time to reply, much appreciated.
The sale took place on 13th September 2001 which was the day after I turned 18. I stupidly applied for a storecard, ran it up then paid the minimum payment back for years. I got myself into financial trouble when I was younger and ignored my statements. I then moved and did not change my address.
All is sorted now with my credit history and everything is paid off. Perhaps I will need to put this down to stupidity on my part. However, I do know that I did not tick the box or request the PPI but obviously the responsibility to check the statements was my own.
The letter I have from creation asks me to write to FOS If I am unhappy with their response. Apologies, I dont know what you mean with regards to the FOS juristriction.

Creation consumer Finance Ltd are just crooks in suits, do not give this company any information,they will just use it against you, they are completely untrustworthy they want you to go to the FOS, instead go to the office of Fair Trading who can really hurt them where it hurts, in the pocket.0

Me again, the more complaints against this dodgy company that go to the OFT will serve to have them investigated, see the consumer credit action group (CAG) website.0

Sorry I missed this before.
FOS cannot always adjudicate on pre 2005 cases but it sounds like it can on yours - you have six months from the date of the letter telling you that you can - a phone call to them should be sufficient to stop the clock.
However, the evidence does point against you.The letter I have from creation asks me to write to FOS If I am unhappy with their response. Apologies, I dont know what you mean with regards to the FOS juristriction.0
