Advice Needed RBS Reclaim

Hi
So I wrote to RBS to claim back my boyfriends bank charges saying that he is struggling to pay direct debits etc etc.
They have now written back to him asking him to fill in a form with all his spending and it is getting passed to a "specialist team" to assess whether he is in financial hardship or not. They said we need to return the form in 28 days or they will assume we now longer wish to complain
The problem being it states that if they find him to be in financial hardship (they probably will) then the are basically reading between the lines going to force him into a DMP with them. This is not what we want as I am currently paying off his debts and getting them shifted pretty quickly to be honest.
Does anyone have any advice or seen this before?
I don't know whether to just leave it now but the charges total over £400 so want his money back!!
