However, I don't think you are going to get anywhere with this one. They will refuse to give you the item and refund your money.
My understanding is (and I am not a lawyer) that you cannot argue you have legal title to the goods when they take the money, otherwise you would have to also take the risk of those items post money-taking whilst in the care of M&S and in transit. This is evidently not the case.
Thats it mate its all about the party depending on it, your also right I will no way get this TV, Its a good point about the legal title and I don't really know anything about it unless as part of the contract is although you have ownership they still have the responsibility to get it to you safely etc. I think that might be the case with online as going by most companies terms ownership passes when they dispatch it.

Ownership passes only when you accept the goods, until that point it is still the responsibility of the company to get them to you in full working order. If something goes missing in transit it is up the company to chase and replace etc.
I think that these mis-prices are always worth going for - you will get one eventually but do expect to be disappointed by most.

Thanks, there calling in the next 48 hours to confirm delivery time, got an email back from the chairmans team, saying they would now honour it after a few emails to them asking why contract wasn't formed when according to their t+c it looks like it could have been. Lot of people over at HUKD did even more and got a good result.0
