I have DRO but creditor STILL calling and adding interest?
Options
Hi,
It's the first time I've posted here, and with all due respect, the answer I'm after is so important to me that I'd be grateful if you only answer if you know you are correct, because otherwise I could end up in serious schtuck...
I got the Debt Relief Order back in November and told all my creditors verbally at the time. All but one have accepted the DRO and have ceased correspondance. But Santander, STILL call me, send threatening letters and add interest to the debt. My concern is that the DRO only covers the debt at the time of activation, and so the new interest and charges above the amount stated in the original DRO will now still be payable to me. Is this correct, or can I just ignore them and tell them to go '**** for it?
Thanks in advance for any help...

You say that you informed them verbally....
the Insolvency Service will also have sent them details of your DRO, but to help the situation it would be worth you sending a copy of the DRO by recorded delivery to them, then you have proof that they received it!:jEngaged 25/12/11 :j

They can continue to add interest etc until the DRO is completed, as legally the debt is not discharged until then.
Assuming that your DRO stays in place for the year and is discharged, the whole debt plus anything they have added is wiped out then.
Santander should not be hassling you to pay this. They can send out 6 monthly arrears statements, as legally they are obliged to do this regardless of the DRO, but any hassle beyond that is simply not on.
Contact the IS DRO unit and tell they you are still being chased.
As said, you could also send Santander a formal complaint and something like the letter/email in this link.

I had trouble with Santander too, all sorted now. Once my 12 months were up I sent them the 'clean up' letter and a copy of a letter I requested from the I.S that just confirms my DRO has ended and that I am no longer liable for the debt balance. At first they didn't do anything when I sent it to a standard address but then I emailed their CEO with the 'clean up' letter and scanned copy of the I.S letter - Sorted in a few days.
