She can put in a claim, which would then stop your claim until the situation is sorted out. If your child lives with you the majority odf the time, though, it should be you that gets the CB. You should start gathering proof that he lives with you most of the time - who takes him to school and collects him? Who is the first person names as contact in case of emergency? Who takes him to the doctor? Whose address is he registered under at the doctors and dentist?0

thank you for the reply.
when he is with me i take him to school and pick him up on Mondays and pick him up on Thursdays and Fridays i take him and pick him up. i have him Mondays Thursdays ,Friday Saturdays and take him back on a Sunday afternoon. the doctors and dentist is at her address all tho we all have the same doctors and dentist. And the school has her as first person as contact . many thanks0 -
I understood that the child benefit was the key to the other childrens benefits such as tax credits.
So if you were the main carer (which you would be 4 days out of 7) you SHOULD be getting child benefit, which would unlock the tax credits and she should pay you child maintenance.
I imagine that finding this out has caused her to change her mind about her childcare arrangements which is why she's getting funny.
In these situations, knowledge is power and you can never know enough. Get yourself down to Citizens advice or somewhere and get yourself armed with the right information.
Good luck x0 -
