Can someone help me. I live in Scotland in a private let. Since moving in in August I have had nothing but debtors at my door for the landlords, including the mortgage company.
When confronting my landlords I was told not to worry it was because the mortgage hadnt been changed to a buy to let. Now January Im still getting letters and they are over £7000 in debt to mortgage. I phoned the company this morning and although they couldnt tell me too much they said that I shouldnt be in the property and my lease is invalid. Can I take my landlords and the agency to court.

You might be able to take them to court but what would be the point ? Your landlord clearly is not paying his debts so all that will happen is that you will pay to go to court and maybe win ( don't have any legal training or knowledge) and he will just add you to the list of people to not pay.There is a race of men that don't fit in; A race that can't stand still;
So they break the hearts of kith and kin, and roam the world at will.

Go to your Local Authority right away. As far as I know all landlords in Scottishland need to be registered. See what they say. Get saving up for your onward move even if that means you stop paying your rent (this is not a risk-free strategy). People in very serious debt can be behave in rather irresponsible and unpredictable ways.0

Hopefully you will be on a 6 month tenancy agreement, in which case concentrate your energy on looking for somewhere else to live once you are free to leave. It sounds like the LL is heading towards financial ruin and foreclosure by the mortgage provider, who are very likely to seek your eviction, so if you get out before then it'll be a lot less stressful for you. You should be concerned about your deposit, I wouldn't normally suggest it but in this case not paying the last month's rent may be the only way you'll get at least some of the money back.0

If repossession occurs the tenant will know about it beforehand. A letter or letters will arrive addressed to "The Occupier" telling them that there is a court date. The tenant should attend court to make their presence known and they should be given two months to make other arrangements, There's a link somewhere around about this two months business. I'll see if I can find it.0

I would go to this website www.landlordregistrationscotland.gov.uk to find out if the landlord is registered. If not then get out, and report.0

You're thinking of the Mortgage Repossessions (Protection of Tenants etc) Act 2010 which applies in England and Wales only.
