Swift motorhomes

Options
Hi,
I have owned a swift motorhome for the last 3yrs, which I bought brand new, it came with a 3 year warranty, which is based on having the van checked each year to maintain the warranty,

The van was 3 yrs old in sept 2011, in november last year I arranged to purchase another new van from a dealership in the north west, a value was given on my van and I proceeded with the deal, on the day of swapover my van was checked out and was found to have damp, therefore the only option was for me to pay the £900 to cover the work, and the dealership told me they would attempt to claim the money back from swift motorhomes, to cut a long story short swift eventually offered me assistance towards this problem, only to withdraw the offer once they found out I had P/X'd the van.

I have repeatedly asked swift if they believe there product should have failed after 3yrs and 3 months, they decline to reply, they now also offer 10 year warranties on basically the same van. Is there not a consumer guideline that can help me in anyway shape or form to get some compensation??

TIA
Andy

a full damp report when the last service within the 3 year warrenty, was done? There may be a claim against whoever did the damp report if an engineers report indicates that the damp could not have appeared (to the extent known) between Sept and November. If you didn't get a full damp report done close to the end of Sept. You may be in trouble as I think a warrenty against damp is conditional on the regular damp reports.

    good luck
  • Hi,
Im not to bothered about the damp report, because at the end of the day, damp was only found 10 weeks after the warranty ended, so its irrelevant IMO.

What Im interested in is the fact that after a short period after the warranty expired, the company do not want to assist me at all, due to the fact i sold the van, which I find unreasonable given the cost of the van and its age, so im looking for any consumer legislation that perhaps states a reasonable time scale a product should perform for.

    TIA

What you are looking for is the Sale of Goods Act.

Have a read of MSE's Consumer Rights article.

You probably already realise that the warranty is not going to be of any use to you.
As well as having expired, you may find it is not transferable.
