WTC and free school dinners

Hi all. I took VR and finished work 31.12.11. I am claiming IBJSA and am getting the 4wk run on of WTC.
On the form for claiming free school dinners for my son at senior school there is a paragraph as follows:
"Child Tax Credit provided that you are not entitled to WTC and have an annual income, assessed by HMRC that from 6th April 09 does not exceed £16,040. Note: From 1st May 2009 where a parent is entitled to WTC during the four-week period immediately after their employment ceases, or after they start to work less than 16hrs per week, their children are entitled to free school lunches."
The LA has rejected my claim for free school dinners for my son at primary school stating that I still get WTC even though its the 4wk run on.
I've rung HMRC and they cannot help me. They say that as I'm in receipt of WTC I cannot claim free school dinners. I read them the above paragraph and they said that they can only help me with queries regarding CTC and WTC!!!:mad:
Does anybody know if there is anything in writing on the net that I can print and show the LA? It looks as though I'll be able to claim from the senior school as its their form that this particular paragraph is written on.
Any help out there???
Thanks in advance

My understanding is that if you receive WTC, you cannot get free school dinners. However, if you are now in the four week run on period, perhaps you will be able to apply at the end of this period, as you will no longer be receiving WTC, if this makes sense.0

I just had to wait till my WTC ended, then I got a letter saying my son was entitled to free school dinners again. Until then he had packed lunches, I don't see what the big deal is!Be who you are, say what you feel, those who mind don't matter, those who matter don't mind. They say that talking to yourself is a sign of mental illness. So I talk to the cats instead.0
