Hi
Wonder if anyone could help? Ive been claiming back PPI paid by me as Im self employed. Sent standard letter from Martins website to HFC & also RBS.
HFC sent PPI paid on a loan via cheque by return for just over £1200.00!
RBS have finally replied to the letter which I sent in July saying that they were unable to proceed with my complaint as no complaint points had been provided (?)
They also have now closed the case on my complaint.
1) Are they allowed to do this?
2) Any tips on how I construct the letter?
When I tried to claim on PPI earlier in the year as was experiencing almost no turnover with my company, I was told me that I couldnt claim because my company needed to have ceased trading.
I then received a letter 2 days later saying that my PPi cover had been cancelled with immediate effect!
Any help would be appreciated.

yes. They have reviewed your complaint and have decided you raised no complaint reasons and therefore they reject it. It would suggest you didnt give any reasons for complaint. Is that correct?2) Any tips on how I construct the letter?
When you complain, you need to state what your reasons for complaint are. Having PPI is not a reason. It is a perfectly valid product to have. it has to have been sold or set up incorrectly for it to be classed as a mis-sale.When I tried to claim on PPI earlier in the year as was experiencing almost no turnover with my company, I was told me that I couldnt claim because my company needed to have ceased trading.
That is correct. A quiet period of self employment is not unemployment. To be unemployed you need to cease paying class 2 NI (i cease trading) and sign on. That is the most common requirement for PPI plans that do cover the self employed.I am an Independent Financial Adviser (IFA). Thanks for replying so promptly.
The letter I sent said that I believed I had been mis-sold PPI as I was self employed. I genuinely did not realise until I tried to claim on it that my company would have had to have ceased trading. Would I able to claim it had been mis sold because of that? Have realised the cover was no use to me at all.
Surely the fact that :
RBS immediately cancelled my PPI after I'd called shows that they a)realised that it was ineffectual for my account? or b) were worried I was going to claim PPI back. Isnt that an admission of guilt on their part?
1 other question, as previously stated HFC refunded my PPI. Are the banks working the their own individual policies on the selling of PPI? Could I point out that another bank has accepted liablility for mis selling?0 -

If they cover self employed, as many PPI plans do, then that is an easy rejection for them.I genuinely did not realise until I tried to claim on it that my company would have had to have ceased trading. Would I able to claim it had been mis sold because of that?
Accident, Sickness and unemployment plans cover accidents, sickness and unemployment. Nowhere in the documentation will it say that it covers quiet periods. So, your assumption would not be grounds for complaint against them.Surely the fact that :

Not at all. Thanks to your new information, they may have been able to tell from that point going forward that the policy was no longer suitable for you. It doesnt mean that it was unsuitable at the start (not saying it wasn or wasnt - just saying that new information later doesnt mean old information was wrong).other question, as previously stated HFC refunded my PPI. It is irrelevent what another bank chooses to do. The member of staff at HFC did not sell you the cover at RBS. The policy terms of the RBS policy will not be the same as HFC. Some banks, like Halifax, are auto upholding all complaints whether you have a case or not. Others look at each case on its own merits. Banks are traditionally a bit scattergun on complaints. Some that should be upheld get rejected, others that should be rejected get upheld.I am an Independent Financial Adviser (IFA).
