I can't offer any advice on this but didn't want to just read it and ignore. Does this mean that the court just disregarded Payplan's information on your ability to pay? If so, that seems both unfair and irresponsible :(

I hope you manage to get it sorted out with Payplan on Tuesday, please let us know.

Hi, yes they totally ignored Payplan's input!!
Second and final LBM 01/01/11 Nearly got there but fell of wagon. HAVE to do it this time

Hi, not posted in a while as all has been quiet on the DMP front... until now! I've been in DMP with Payplan for 16 months and at my review I upped payments from £101 to £120. Always paid on time. I owe £2300 approx on N'wide CC. They decided last Dec they wanted more than the £10.50 sorted out on DMP and offered f and f of £1500 or £50 a month. I rejected this as knew the moment the apple cart was upset on DMP ie one creditor suddenly getting more, then the plan would fall apart. They sent court papers and Payplan legal team returned them with my I & E and offering what I already pay on DMP.

Today I've got a CCJ for £85 a month instalments!! I'm going to ask for redetermination hearing but sods law, Payplan now shut until after Monday for advice!

Any advice? I'm worried as last month a got 10 months back pay of £120 plus earned £250 overtime but this isn't regular and in fact has all but stopped, so if I take recent bank statement, it looks like I'm lying about income. By the way, I spent extra on having dead and dangerous tree removed from garden, so not on luxuries!! I'll also post on main Debt free forum.

    Hi Squirrel

I haven't heard of the courts making you pay more than you pay via PayPlan/CCCS because the courts know if you are with them, they have helped you plan your budget properly and that is all you can afford.

Are you sure the creditor submitted the paperwork properly? When we got a CCJ we had a notice to say we had to pay everything immediately because the creditor had lied about not receiving paperwork from us in order to force an "immediate payment" judgment.

We phoned up the court and got it sorted out though, so ended up paying monthly what we were already paying to the CCCS each month.

Let us know how you get on because I would be surprised if it wasn't an error or the creditor has put forward the wrong facts.

    Hi guys and gals,

I am putting in the paperwork to CCCS this week to get our DMP running. We are 1 month behind on our mortgage (£472) and 2 months on council tax (£170). Our DMP plan has been set for £50 for the first couple of months to allow us £210 a month to pay toward mortgage arrears and £43 a month towards council tax.

However hubby has just started a new job and got his first pay packet at the end of April in which he had racked up 48 3/4 hours of overtime in 3 weeks! If our additions are right, his basic salary a month is about £850 a month, but at his current rate this month his pay should be about £1700.

Obviously I have set the DMP to his basic wage, but I am thinking that as the mortgage is due at the end of the month (in fact the day after payday), that it would be more beneficial to use the extra to pay off the overdue council tax and mortgage.

Now as the first payment to CCCS will be going out 1st June I hop, there will not be any time for me to change the amount as payday is the 28th. Therefore, once I have the paypacket and have paid the priority debts, do I call CCCS and notify them that these have been paid and therefore they can change everything for 1st July's payment?

our debts amount to £24087 with £16761 of that split between 2 companies and most of them will probably complain about the amount they are offered, but then they will get another letter I am assuming giving them the revised payment figure.

As hubby is only contracted to work at this firm until end of December, we intend to throw all our spare cash at this as long as we can. However, as the overtime is not guaranteed, if we get extra in the coming months which is more than likely, are we best giving it to CCCS to split between everyone or are we best off throwing money at the smaller debts which will in turn free up more money for the bigger debts. Also I presume the companies notify CCCS once the debt has been satisfied?

    Sorry for the long post!

  • Hi all

Im new to this site and today finally bit the bullet and pulled my head out of the sand. After spending a whole day worrying about not having enough money for food or petrol for the rest of the month I contacted CCCS to arrange a DMP to pay off my £23,000 debt. Scary thought cancelling my direct debits as although only managing to pay minimum payments I have always paid even though I had to use credit cards for essentials to supplement. Got to a point were all my CC are maxed and had nothing to fall back on so had no choice really. Still feeling anxious but also a little relived to be finally facing my debt problems. I have been inspired by everyones stories and have found them all supportive. Hears to finally dealing with my debt problems:j

    Hi Geminimum
My understanding is that your payments should be shared fairly between all your creditors. I would call CCCS and ask them the best way to handle the extra income hubby earns as this will probably change from month to month as overtime isn't guaranteed. Some people would keep the extra money and put it away for a rainy day especially as you say this job finishes at the end of the year.

    Hi everyone,

I've been away from these forums since September as things were settling down since starting my DMP in June last year and I was even managing to put some money aside each month.

Well I've just completed my review over the phone this afternoon and I have had to reduce my monthly payments from £292 to £131 and am worried on how this will look with my creditors :(

I've had my tax credits taken away and then over all more expenditure with bills etc... I haven't been able to save any money for about 6 months now and in fact have used up any money I did have saved up and am feeling quite depressed about it all.

Has anybody had any experience where they've had to reduce their DMP payments and how was it taken by the creditors? I'm trying to go back and scrutinize everything I'm spending money on as the call today has made me realise I have let things slip again and I can't afford to be back in the same position I was in.

    Would appreciate your responses!

    Thank you!

    Hi Max

So glad you've decided to face things. I was in the same situation you're in. I came to my senses about 1 month ago,
I'd been using my CC's to pay for food and fuel, I had no idea about budgets or anything. Believe me I've learnt loads over the last few weeks!

I contacted the CCCS and they were brilliant - I'm currently in the process of setting up the DMP to start 1st June. I'm scared of what the creditors will say but at least I know I'm dealing with my problems - thats a such a good feeling!

I've had loads of advice on here from people who've gone through the same thing as me, hopefully you'll find it useful too.

    Good luck!!

I have had my payments reduced twice whilst on my dmp - I started at £374 a month, then it went to £312 and £265. I got one not very nice letter from Natwest but that's been it. Simple truth is that you can't pay more than you can afford, and if your budget has been sorted out reasonably (as it will have done) then they can't really complain - you're still making the effort to pay.
Life is generally tough at the moment, the cost of everything is going up, wages are frozen and benefits are being withdrawn. There's less spare cash once the essentials are paid.
I was lucky enough that last month I was able to increase my payments again to £339 as my ds turned 3 so I got extra cash from nursery fees being partly paid. Again, no letters of acknowledgement or anything. I just keep paying the money and hoping that the balance is going down.
    Good luck

Hello everyone, just an update to let you know I read all the posts when I can, and we have now reached the dizzy heights of £31,000 paid off our DMP!! The (still massive) total is now £37,000, but come August we will be half way there. Other good news is that Sainsburys Visa, and OH BOS c/c have been sold on to collection companies. Hopefully no more interest on those, they were really impacting our figures.
It seems so long since Oct 2009, but Payplan have been brilliant with us, I dread to think how much deeper in the mire we would be if we hadn't taken positive action, so very best wishes to everyone cracking on with it, like us.

    Good Luck, everyone,

Hello everyone posted this on the main thread but thought this would be better.

    Lightbulb moment 08/05/2012!

I have received the information pack from CCCS but have a few queries.

    1. Do I stop paying creditors now by cancelling the DDs? If I do will this not count as a default? Should I even be worried about this?

    2. Do I set up another bank account or can I use my current bank account as I am not in overdraft? My current account is also with one of my creditors.

    3. I am in the process of moving house so can I send my change of address with the letter saying I'm going to be starting a DMP to my creditors?

I'm just so unsure of what to do when?

    Many thanks.
