DMP & Mutual Support Thread - Part 8

Hi everyone
DMP has been running with little concern except a couple of letters I have received in the post. 1 was from Lloyds TSB passing me on to a debt collection agency for the amount I had gone over my overdraft... my overdraft was at it's limit of £3000 but is now at £3190, due to charges etc. I did receive a letter from them after they were informed of the DMP saying they accept the monthly payments etc. Any idea why they have done this now? The amount they are threatening action with is the £190, not the whole £3190.
Also, a debt collection agency dealing with one of our smaller debts saying they had agreed to our payment with cccs as long it was every 30 days as stated but that it was late? My CCCS payments have all been made on time with direct debit so not sure where this has come from?
I will have to make some calls but not able to until this evening:mad:

One of my debts is my overdraft with Lloyds TSB and when I started my DMP, they increased my overdraft limit to accommodate their charges. I was really cheesed off about this at the time but later experience with NatWest made me realise that they had actually done me a favour
Is it worth asking them will they do the same just until your DMP payments take you back inside your limit?
CCCS make their payments on the 25th of each month and this means that some of our creditors consider their payments to be late because they are actually due earlier in the month. Maybe this is what is happening, it could be worth letting them know that the payment will always be on the 25th and asking will they change the due date.

Can anyone give me a bit of advice?
My DMP has just started and I am starting to receive letters from creditors regarding my offers of repayment.
First Direct have accepted my offer but are now asking me to sign a Consumer Credit Agreement which will sign me up to the agreed payments over 12 months and then a final payment to clear the balance which I won't be able to afford.
It is set out to look like a further loan agreement to me so I haven't signed it on advice from CCCS and have written to them to explain why, however I've now received another copy and another signature request.
I am right not to sign it aren't I??
Just an update on my previous post, I've put in writing to First Direct that I am unable to sign the agreement and that I will continue to make monthly payments as agreed, they have contacted me to say that if it isn't signed they will pass it to a debt collector.
Is this usual?, it all seems a bit quick when they have accepted the payment offered and I'm only in my first month of DMP?

if they are sending you a credit agreement, then this goes against all the DMP stands for, and by accepting it, you jeopardise the DMP.
Personally, I would re-write to them, telling them that you are on a DMP, quote the number of the DMP and tell them that you are unwilling to enter into any further credit agreements. Also add that you will not deal with any collections persons that may try to make an appointment or turn up at your home, and that all corrispondence is to be made to your DMP managements company (CCCS / Payplan). If you do a search, there are plenty of template letters on here that can be customised to suit your needs.
and again, insist that you will not sign any credit agreements (sounds like scare tactics to me)

Thank you- I didn't realise that they pais creditors on the 25th, I will send the DCA a letter! With regards to Lloyds, I very much doubt they will increase the overdraft to cover the extra costs/charges (I think they hate me :rotfl:) but I will talk to them. Thanks again :A0 -
Just a quick update on my situation........
Since I answered the phone and started to talk to creditors they have all agreed to put a 30 day stop on my account meaning no calls, interest or charges, I have had no calls this week at all after receiving regaular daily calls, so for all newbies like me I would say if you feel confident enough answer the calls just stand by your guns and don't let them pressure you, nearly all mine were really nice.
I have had a letter from MBNA accepting my DMP and stopping all interest and charges woohoo :j. Still waiting to hear from the rest.
Still really worried about my Natwest overdraft after what I have read on here but I am just within my limit so I have paid enough in to cover interest until first DMP payment as I couldn't cope with daily charges and my DMP offer for this is above the interest rate so whilst they probs won't stop or reduce interest because of this at least the debt will decrease and I won't get daily charges.Debt Starting Point £51,442 - Current Debt £51,442 -Debt Free Date Aug 2018 :T0 -

You would think though wouldn't you that the creditors know CCCS pay on the 25th. After all they must have loads of people paying them back through a CCCS DMP.
Had a default letter from MBNA today which also said they wouldn't be sending me statements anymore. How am I supposed to keep track of them now?:(DMP Mutual Support Thread No. 421

Sounds like a good name for a book LOL Hi everyone. Not been around for a while but with good reason. My husband and I have separated after 22 years of marriage. He moved out at the end of January. He works I do not. I am a full-time carer to my daughter, who has special needs and whom I also educate at home.
We had a joint DMP which began in 2010. We continued to pay it up until March this year. I then dissolved this one and set up a single one in my name and my husband is in the process of setting up his own too. We split the debt and I ended up with the smallest amount as I am trying to take on the mortgage which has a lot of debt in it through remortgaging anyway. It was a pretty quick turn-around and I only managed to miss one payment but I'm back on track and should be out of debt in 2 years or so. The mortgage is a whole other animal and whether I end up staying here or not I'm not quite sure. It's complicated.
Because I knew what to expect and had done the research in advance, all of the benefits came through as expected after a few weeks and I managed to get ahead on the bills by not spending any money for the first month and I am now about a month in front so I can pay all the bills as it was tricky in that I get paid every four weeks and of course all of the bills go out every calendar month.
I'm almost at the end of the process and by the end of April I hope I can continue steadly for at least a few years. I'm paying interest only on the mortgage for the next year at least with a possible two more years available but I want to start paying the mortgage as soon as possible so we will see. Work opportunities are a slim possibility with looking after my daughter but I will see what I can do. Just thought I would post this in case anyone else finds themselves in a similar position. There is light at the end of a very long tunnel.

will this never end!!!????? Despite us sending numerous letters to metropolitan and apparently them never getting them. I sent one last week on the 12th special delivery and its still showing on royal mail as progressing through their network!!:eek:
So now today OH received a letter from D G Solicitors (thanks to Metropolitan) saying that they want full payment now of £7290 (yeah right like ive got that!) or they state: we may be instructed to take legal action against you in the county court to recover this debt. must pay this in 14 days blah blah blah. If you need more time to pay then contact us etc. trouble is my hubby is going through some tough times with his business and is on the verge of a mental breakdown.
So I have today composed another letter this time to D G Solicitors and put ALL the copies of ALL the letters that we have sent to Metropolitan.

I've just received the following after taking advice from CCCs not to sign a CCA from First Direct, has anyone been in a similar situation? Any advice gratefully received......

I'm sorry that you feel it is unfair to pass your account to a Debt Collection Agency. I hope I can explain the reason why we would have to take this action.
As you have a Personal Loan with first direct, the account will only accept contractual payments, in this case 86.49GBP. In order to accept the payment offer from CCCS of 48.13GBP then we must move the debt on to another account that will accept the lower repayments.
As you are currently covered under the Consumer Credit Act through your Loan, if we move the balance without the documents signing then you will not continue to be covered. The account would be passed to Metropolitan Collections, even if payments are being received.
All customers with first direct that are on a Repayment Agreement must be covered under the CCA for their own protection.
We are aware your payments are coming via the CCCS and this is perfectly acceptable. If you have received a Standing Order mandate with your Documents then please destroy this.
It is, of course your decision. As a responsible lender we must give you all the information so you can make an informed choice.
