bank takeovers

can any one help,

I have recently sent a plp claim for a loan i took out 6 years ago, i still have all the correct paperwork but the problem is the loan was with Alliance and Leicester who have since been taken over by Santander, i sent it recorded and when i tracked it the letter is being returned to me as they are no longer there.
Do i now send it onto Santander for them to resolve or will they say the agreement was not with them, any advice will be welcome

    Ive had the same problem I had a Mint credit card and theyre now owned by RBS so im trying to deal with them instead.

    quick edit for you, just forgot my wife got a letter through today from santander and they have upheld her complaint she made on friday so theyre quick unlike Lloyds

    Santander deal with all A&L loan PPI claims,they took the responsibilty for the complaints side when they bought A&L.

    Santander deal with all A&L loan PPI claims,they took the responsibilty for the complaints side when they bought A&L.

    I've claimed on 2 A&L cards (from around 2002) and 1 Abbey card (from around the same time). The Abbey was sold to MBNA in 2001 just like A&L were in 2003.

    Santander say they can't find all 3 accounts so can't look into my claims. They say only the mortgages and savings side of A&L was taken over and nothing else and that the credit cards were ALWAYS administered by MBNA, who in turn say they will refund only from the date they took over the cards and not before (as they didn't take the premiums). Their other response is that they won't refund any PPI because it wasn't sold by them (which is true).

    Santander have asked MBNA to look into it who then say they don't have any details (the A&L cards were closed before the sale).

    That leaves me with no-one to claim from !!

    My complaints have been with Santander since September and to date I have not had a final response, only that they're looking into it (for the Abbey card). The A&L cards they won't register a complaint for.

    Santander also took over responsibility for A&L unsecured loans as well as mortgage and savings.It is correct though that the A&L cards were and continue to be run by MBNA.
    I can't help much with MBNA's response to you since i have no experience of claiming with MBNA.I would have thought that when they took over the A&L cards and rebranded them as MBNA they would also take over the responsibility of the complaints side.

    Santander didn't sell the PPI on A&L loans either,but in their credit they deal with the complaints and issue redress.

My view is that they accepted all liabilities and duties when they took over but their response, after consultation with their legal team, is that they are not responsible for any charges/fees before their admin agreement with any bank. Their response came from senior management. This is what they say for the Abbey card. But I paid more premiums before the transfer to MBNA than after it.

    For my complaints, Santander say they cannot find any details (and neither can MBNA for the A&L cards) so can't investigate my complaint.

    That leaves me with no lender to claim from.

    I suspect Santander may do this for many complaints.
  • thanks for all the info, i still have all my details and i am still paying the loan, now to Santander do you think this will help the claim seeing as its still active, so they must still have my details on file

    For what its worth i agree with you.If a company takes over the assets and agreements of a another company they should also take over the complaints aspect.I'm sure if customers decided that any spending they did on the card prior to MBNA's takeover was not valid they would disagree with that most strongly!.
    They should take the rough with the smooth in my view.Perhaps its worth a call to the FOS and see what theit viewpoint is?

    Yes they will have your details,no problem there.
    One of the main things to check on your loan is whether it was a front loaded single premium type.Many if not all A&L loans were.
    If the ppi premium was added to the loan at the beginning and then interest applied on top this is front loaded.
    This is a very strong reason for complaint in itself,it was a bad product heavily loaded in favour of the lender and the FOS take a strong view in your favour on these.

    I would make that your primary complaint area and back it up with whatever other reasons you have for mis sale.
    Santander are dealing with these complaints quickly at the moment so don't delay !

    Already went to the FOS a few years ago before the FSA investigation into PPI.

    MBNA initially agreed to refund all premiums plus £100 for the inconvenience but then changed their mind and said no because they didn't sell the policy.

    This second time they've paid the premiums they charged but not those from before their admin agreement. Again because they didn't sell the policy and apparently they sent me a new policy when the admin agreement started.
