Replace or repair

New to this or any other forum. Flat screen TV purchased 13 Nov as a Christmas present worked fine from christmas morning until 7 Jan but now switches itself off then back on. Store agrees that it is a fault but want to send it off for repair and refuse to replace. Does any body think that the TV is fit for purpose and that it lasted a reasonable time under consumer rights legislation and the sale of goods Act? Store not named yet but one of the countrywide groups.

It is reasonable for them to send it away for repair when it is almost 8 weeks since you bought it.

It was purchased for a Xmas present therefore it's entirely reasonable for the period to inspect the item not to begin until Xmas day onwards. SOGA allows for this.
True, but if sticking strictly to the law, I would posit that 12 days is more than long enough an inspection period. For a TV, the inspection period could well be only a day or two, particularly as it is likely to be heavily used over the Christmas period.Squirrel!If I tell you who I work for, I'm not allowed to help you. It covers things that cannot reasonably be inspected immediately (the skis example) but just choosing not to check it for a few weeks? Not so sure myself.0 -
