Another item not as described...

Purchased a Nintendo DS game, advertised as brand new sealed un-opened from a UK based seller.

Firstly, it is not sealed, but can't tell if it is used or not.

Secondly, put it in the DS and I get an error and after looking closely at the game and the box it states for sale/rental in USA, Canada only. This wasn't advertised in the description as these games are not compatible with UK models.

I haven't yet contacted the seller, they do state that returns are accepted. As it is not as described do I get the return postage back?

    You can ask! If they are a business seller then by law you should get it back but unless they give it back voluntarily you would have to chase it via small claims/trading standards/etc - probably not worth the hassle! eBay cannot force a refund of more than original total cost.

    They actually state the following as well:

    No wonder their feedback is so poor.

  • Their prices seem very cheap. Technically their terms which are non-complaint with the DSR regs entitle you to a refund within 30 of requesting and only having to make the goods available for their collection but enforcing this might be a bit difficult.

    You can only ask, another neg on their account won't help their business (don't mention feedback in your complaint), especially if it mentions imported games which I suspect the seller knows as their other listings don't state they are UK editions just that they work on UK consoles, if they are smart they will give you what you ask for.

    Normal DS games have no region-locking and DSi enhanced games do.
    Maybe this is why he thought people wouldnt notice x

    Since its an ex rental though id be thinking it was used, open up a SNAD and tell him you arent happy

  • I'd contact the seller letting them know it's not as described and asking if you can return at their expense for a refund. If they don't answer or say you have to cover the return then I'd open an eBay case, you might get a no fault refund or the seller will have an 'opened case' counted against their account (unless they resolve within 3 days I think) if eBay instruct you to return.

    Quite right. In fact I bought several games for my DS from the States and Canada as they were invariably so much cheaper than over here, even with shipping, and quite often came out months before they did in the UK.

    However, regardless of this, if it's not working, just open a SNAD dispute
