Yourcalls.net cancellation..

Hi,
I originally signed up for a 12 month contract with them - which expired back in Sept 2011.
I've emailed today to say that i want to leave and go elsewhere. They've got back in touch saying that i am on a rolling contract which finally completes in Sept 2012 as per the new OFCOM regs and there will be a £60 cancellation charge if i leave now.
I know their t&c's say there is a £7.50 charge for every part/full month remaining but i was not informed that my contract was roliing and that my initial 12 months was finished in Sept 2011.

Do i have any come back?

    Did you read the original T&C's? I it's there then no comeback really, if the new contract commenced back in Sept.
    Whether they would seek to enforce it is another matter of course.

    more than sure that the intial contract did not say that it would be a rolling one

    Then challenge it. But more than likely it was buried deep in the T&C's-it always is with these resellers. At least they didn't hook you on a 5 year contract.

    i'll give it a good going over when i get home
    so basically....if it isnt there they cant enforce, but if it is then i'm £60 lighter ?

    They can't make you pay, but they can obstruct your transfer and trash your credit record for 5 years.
    If it isn't there, what is there to enforce?
