Do you work for HR also ?
Forget it. You were struggling to accept a concept not in line with your thoughts, I was trying very hard to nudge you that way because plain logic and explanation of the law was not working.
If you are having a strop with everyone who gives you the unpleasant truth, so be it.
Anyone who tells you you have a case is not being truthful I am afraid. Last advice - don't pay a solicitor for this one. Sadly you are probably too late to join a union.Debt free 4th April 2007.

1. Are you a solicitor ? If not then please don't offer legal advice.
2. I was asking for legal advice, not to be patronised Emmzi. I am well aware that my team may have to endure the horrendous situation they are now in.
If someone is patronising then I will respond in a similar manner.0 -
SarEl is the barrister.
I am the HR women working on TUPEs for at least part of the time. I take legal advice for the difficult legal bits.

I'm here to ask for legal advice, not to get patronised by morons like yourself. I want to know if the employer is acting legally you moron and Emmzi is achieving that without your input.
Nothing you have said contributes to this thread and it's probably the case for the entirety of your life.
How about you dont' suck it up for about 5 minutes (air)
Nope. Wrong. That was your legal advice! I'm a barrister.
You have listened to absolutely not a thing that Emmzi was telling you, despite her many efforts to tell you honestly and forthrightly that you - you - are the one who is not listening to reason.
And whether you like the contribution or not - it's the legal position and you can like it or lump it. Redundancy isn't a right. You'll find plenty of people on these threads who would be grateful to have a schance to have a job, to delay redundancy, or whatever, and all you can do is whinge that it isn't fair that you can't have your own way, right now.
But I do disagree with Emmzi on one thing - please feel free to waste your money on legal advice. You will find it differs not one jot from what you have been told here.0 -
I was TUPE'd in to another computer company they "found" certain roles where not required anymore and screwed some of us over, best thing for me 6 months pay tax free and a boot up my !!!! to do something else as I had become bored but comfortable.

Well that does explain a lot!
People skills, I find, are often lacking in many professionals that work with people. No offense to anyone with this condition.
It's a shame that your SarEl decided to comment - until that point you were giving professional and personable advice - so thanks. I know 'he' probably feels above most people, which is a shame really as surely he's (or she) on this earth with great skills to help others. Not patronise them. Although you don't often hear great things about barristers do you?. I'm sure that's not true though...... ?
I can recommend this website to ElSid:
dub dub dub peopleskills dot org dot uk
PS. I think we are now discriminating against small dutch people ? They don't only make recorders you know ...
Again, many thanks for your 'help' and 'advice'. My team will go forth, suck it up, and enjoy this pleasant time whilst browsing the net for new jobs.
[To make it clear to others I have consulted a qualified legal professional and that person has confirmed that we will be looking at grounds for 'removed material in the even my future employer is reading this' when 'other' conditions have not been met.
BTW the person I had advice from did not have a recorder in his hand and he was certainly not dutch. Although he may have had one in his back pocket (am I talking about a recorder or a dutch person?)0 -

LOL brilliant thanks ! you've put a smile on a face that had none.
Did the boot help ?
We are not bothered with Redundancy - something that Elsid missed due to GodGlasses. We just want a fair and legal game.
Can't tell you the name of the companies I'm sorry. That in itself would not be professional here I don't think. Not yet.0 -

ElSid. There's no way on this god given earth that you are a barrister. Your grammer and wit is so poor that I would barely put you in a court. I know several barristers and they would not respond as you have. I have no interest in your comments and got as far as ElSid.
BTW. Redundancy is a legal right for those with such conditions in a legal contract. A 'real' barrister would know that.0 -

If it is a large company and that have down this in the past i.e. bought out outsourcing contracts or have taken them over then by and large they will know how to play the game and it should all be above board. Basically if they want to fcuk you over then they will.
I was in a dead end job bored out of my head and hating it, I got made redundant took 11 months out and just did !!!!!! all, had great ideas in starting a new career but its tough in a recession so went IT contracting and I'm enjoying it a lot more.
Happy to have made you smile................. :T0 -
