Help regarding a credit agreement

Options
Hello Everyone

Some advice required, two and a half weeks before christmas i ordered a treadmill as a present and when ordering was assured it would be with me before christmas. I went with finance as they had a 0% finance deal going on so i gave a £179.00 deposit and left. I was told to expect a phone call arranging delivery between 8-10 days, this did not happen and on the Wednesday (21st) before xmas i called them, was assured that it would still arrive on time and it was with the delivery company. On Friday 23 December we got a call saying that delivery would be on 30 December - no use to me as it was after christmas. I tried to phone the shop and they were not answering the phone!!! I then phoned the head office and spoke to a lady who agreed that i could cancel the order and agreement and she was going to email me cancellation forms. They never arrived and when i chased they were closed for xmas. I tried to phone them on 28 December and again they were closed so i sent an email to them and the head office. I received a reply from the head office stating that the order was cancelled and i was going to receive a refund for my deposit. Then on 6 January i received a voice message from the actual shop claiming that i am not entitled to cancel the agreement as it was signed in the shop (even though mis sold!!) i spoke to the finance company who have said that they can only cancel via the retailer and i can never get the retailer on the phone. I have an email saying they are going to cancel the order, the shop are saying i cant cancel and there is a finance agreement with my name on it and i dont have any goods!! Xmas has passed and i no longer require the goods. What do i do???:mad:

You need to cancel the order with the shop and get them to cancel the finance.

Keep going back to the shop and pester them to cancel the order as they didnt deliver as originally agreed.

You will be in a bitof a tough place when the finance companystart colelcting and they wil lassume you have the goods etc - so you may need to explain the situation to them.
