Rent too High

This question is directed to Landlords - if you are able to help please?
My in-laws rent an annex, however my BIL broke his leg and has been signed off work for 6 weeks unpaid. They then applied for housing benefit for the period he is out of work. A lady from the council came round and told them that they are paying at least £100 too much for the property and that she is going to write to the Landlord. So what happens now? Does that Landlord have to take any notice of the letter? :confused:

    I wouldn't think so, we have this problem all the time in Cambs with what the council call 'Rent Pre-determination' They will usually look at the property in question set a figure and if there's a short fall the Tenant will have to pay it. We have found with some Landlords that they increase the rent because they think the council will pay more. This is not the case and i've never heard of one where the Landlord is asked to lower the asking rent. They pay a certain figure and thats it. However it may apply differently with other councils elsewhere.

    i wouldn't think so either. I don't think the council mean that the rent is too high in general - after all rent is determined by how much someone is willing to pay for it, and your inlaws accepted our it. what the council means is that the rent your inlaws pay is more than the council pays HB for for the same sized property within the borough. Therefore your inlaws would have to pay the extra that the council don't cover.

    I see what you mean, I believe they do pay a lot though, £600 per month, but I suppose as you say they did agree to it.
