Returned parcel from a buyer

I sold a Sat Nav on Amazon on the 13th December. I posted it out on the 15th and provided the tracking as I sent it next day delivery.

I checked the tracking next day and it said delivery could not happen as no one was in and it had been taken back to his local depot (Well not in them words but I cant remember word for word). I Thought nothing of it and with Christmas on the horizon I forgot about it.

The buyer has not emailed me once so I thought nothing of it. And Amazon have not come to me either.

Today the parcel has been returned to me as no one went to pick it up. I have emailed the seller but still had no reply.

Any advice?

    Either do nothing and await for the buyer to contact you or resell it and refund the buyer. Problem solved.
  • I have had this happen to me twice recently. Both times the buyer took ages to respond but when they did I just put it back in the post with the original stamp or postage sticker, I just removed the return sticker. And it got to them fine.

    This actually happened to me also a few years ago, although it was a second hand blender. I put it in the understairs cupboard then completely forgot about it until about a year later had a clear out, which reminded me - the buyer never did get in touch, nor was a refund issued :o

    I remember I sold tickets to the disneyland paris park (remaining days i hadnt used due to the kids being too young for a lot of stuff....seemed more geared towards 12-13 year olds than kids around 6-7).

    Contacted buyer to make sure she had gotten then (had sent recorded delivery but can never be too careful) and didnt get a reply. About a month goes by and i get an email from buyers mum.....tickets had arrived but buyer had been killed by a drunk driver. It had taken her that long to get access to her daughters email account. She was going to take the kids the next year as their mum had been saving for years to take them.

    Still makes me sad thinking about it.

    Hopefully not with a tracked item as seller could never prove delivery if buyer did a chargeback.

    I was just wondering what the legal points of this are.
    The purchaser has paid for the goods & so at what point does title to the goods become theirs? (I know that in itself can be a complex area from what I've read previously on the question) Upon delivery?

    As delivery has been attempted would it be reasonable to contact the purchaser giving them a timescale to arrange redelivery of the goods before possibly re-selling them and refunding the original purchaser, less any shortfall (as they did enter into a contract to buy the goods at the agreed price)?
