Redundancy Questions

Hi

Few minor questions on redundancy payments.

Under statutory redundancy the min varies depending on years of service. Also seems to vary depending on age at the time of that service, with 1 weeks pay per year of service when under 41 and 1.5 weeks pay per year of service when 41 or more.

Few details on this if anyone can confirm. What counts as a year at that age. Ie, does the year of service in which someone turns 41 count as under 41 or 41 or over.

Secondly, the amounts count for each completed year. However does the completed years count until the date someone is told they are being made redundant or the final working day (or some other day)? Ie, if someone has 3 years 11 months and 2 weeks service they will get 3 weeks statutory min notice, but that puts their length of service over 4 years. Not sure if this would mean an extra weeks notice required (and hence an extra weeks pay).

Lastly, what are the minimum time scales for initial advice that someone might be made redundant through consultations to redundancy notice in a small company (the 30 and 90 day periods only seem to apply to larger companies).

    It's each completed year (max 20years) up to the day you are made redundant not the day you're given notice and it's the age you were on each yearly anniversary that determines the weekly rate for each period

    And if there are fewer than 20 emplotees being made rdeundant there are no minimum timescales.

    For service you count back from the relevent termination date for redundancy not forward from the start date.

    Thank you. Confirmed a few things. Minor plus point for me is that my contract notice period is 30 days so more than the statutory min.

    Still unsure on the 40 / 41 year old cut off.

    You count the years backwards from the relevant date.
    The 'relevant date' in this case is the date on which your employment ends, i.e. the last date of your notice period.

    For example, if your notice runs out today; you count backwards each year to 11th January and each year that you were aged 41 or over for the whole of the year you get 1.5 weeks redundancy pay.

    So if your birthday is 10th January you would get 1.5 weeks pay for the year following your 41st birthday.
    But if your birthday is 12th January you would only get 1 weeks pay for that year and 1.5 weeks thereafter.
