Barclays PPI - Old Loan

I had a 5 year loan from Barclays which was taken out in 1999 which I paid PPI on. I no longer have the paper work, so called Barclays to ask if they still did.

They advised me to write in and they would send me anything they had - which I did (not a SAR though - thought I would see what they came up with before shelling out £10).

They haven't sent me any details of the loan, but they have sent me a PPI reclaim form. I'm going to fill it in as a punt.

Do you think it means they have found the documentation or do you think they send everyone who mentions PPI reclaims one automatically?

    I've got a PPI complaint going through as we speak, although I am fortunate to have almost all of the original paperwork (call me a hoarder!). Barclays tried to fob me off but I am still making progress - search for my topic for more information: "Old Barclays loan PPI claim - need help with negative response".

    I think the first person you spoke to fobbed you off and form is now required so they can locate the information and why you think you were mis-sold.

    Not sure I was fobbed off. I called them and said I was trying to trace the paperwork for an old loan (didn't mention PPI although they probably guessed). They put me through to the archives department who said a search for a loan that old would have to be requested in writing.

    I sent my request, they sent me a form.

    Like I said it is a bit of a punt because I have absolutely no paperwork apart from some bank statements from towards the end of the loan which show the repayments.

    I think I was mis-sold for several reasons - I was a civil servant in a secure job which would have given me six months full sick pay and six months half pay. I also made it clear to the personal banker that I would dropping to part time hours a few months after the loan was taken out to go to uni full time which I think would have voided the PPI.

    She was also aware that while the loan was in my name, the repayments were coming out of a joint account, so had I not been able to pay, my hubby (fiance at the time) would have made the payments.

    I'll send the form off and see what happens. I think I'll do a simultaneous SAR as well just in case.

    The form you were sent is to make a complaint about PPI. Not to trace the loan. Hence why I think you were fobbed off. Its an old trick that someone on the phone doesnt want to do the work so they tell you to write in knowing that the chances are someone else will have to do that job when it arrives or you wont even bother writing in.
    I'll send the form off and see what happens. I think I'll do a simultaneous SAR as well just in case.

    You dont need the SAR at this stage. You just need to give them enough information for them to locate the loan. If they cant find it on the complaint then you can do the SAR to verify that is the case (if two different departments cant find it then its end of the road). I wouldnt waste £10 at this time though. Wait for the complaints team outcome first.

I wrote to the bank with a cheque for £1 asking for a copy of the agreement and they wrote back telling me as the loan was fully paid off they were not obliged to send me a copy of the agreement.

    Part of me can't be bothered with the hassle (as the bank no doubt was hoping!) but I do want the money back off the "theiving barstewards."
    I have the simplest tastes. I am always satisfied with the best.

    just found this on Barclays website under FAQ

    "With payment protection, how do I make a claim?

    You can get your local branch to arrange for a claim form to be sent to you or you can download the claim forms from the Guides & forms page. You will need to complete the relevant form and send it to the address shown on it. Please ensure you select the relevant form.

    In addition, for Payment Protection Insurance claims for overdrafts, Barclaycard and mortgages, you can call Barclays Insurance Dublin on 0500 500 700, Monday to Friday 9am-5.30pm. Textphone: 0870 400 4855. Disability helpline: 0870 400 4854."

    Also In their Overdraft Payment Protection Policy Document (also on their website) it states;

    "7. Data protection
    You have a right to see personal information which is held by Barclays Insurance(Dublin) Limited or Barclays Assurance (Dublin) Limited. There is a charge if you want to do this. For more details write to
    the Data Protection Co-ordinator, PO Box 586, Shannon, Co. Clare, Ireland.
    Alternatively you may contact the underwriters directly by calling 0500 500 700*, by faxing 0870 400 4865."


    I have found the Dublin office to be helpful. Worth a try?

    I'm in a similar situation and am not sure what to do next: I have an old loan, couldn't find any paperwork although did find the agreement number on old bank statements.     The CCA request isn't useful unless the account is "live" so its a SAR you would need,but many banks will come back and say no info older than 6 years (although when pushed and challenged many later suddenly "find" the info when they realise you won't be fobbed off.

    You could just plump for a speculative claim and bang it in,barclays tend to make offers even when they "say" they don't have the documents.Usually a low amount but better than nothing,or can be a starting point for negotiations.
