does a section 8 affect your credit score?

    Thank you both millions! I might be receiving one :s am trying to get everything sorted tho it's just if my housemate doesn't pay there share of the rent we might get one :( our situation is we are late paying rent this month as one joint tennent has moved out and not paid rent for this month :( first time we have been late paying tho so hopefully they will be a bit more understanding! Thank you both for your advice! It would only effect credit score if we didn't pay any fees or rent and they took us to court eg possible ccj?

    Taken to court and ordered to pay rent arrears.
    You pay.
    No credit record.

    Taken to court and ordered to pay rent arrears.
    You still DON'T pay.
    Now your credit record is affected.

    Given your position it's best to deal with this now, before your LL gets annoyed/issues S8.

    I'm assuming this is Eng/Wales, and the 3 of you signed a single 'joint and several' tenancy agreement? The LL does not care about 'shares' - he just wants the full rent for the property and can demand it off one of you, 2 of you, or all 3 of you.

    The best solution is to speak to him and explain.

    He may be willing to give you breathing space if he understands your problem and believes you are doing all you can to solve it.

    He may be willing to let you find a new joint tenant (subject to him vetting/approving that person), cancel/accept surrender of the current tenancy, and set up a new joint tenancy with the new name included.

    He may be willing to chase the departed tenant for the 'share' that person still owes under the contract even though he's left.

    He may consider other compromises.

    But only if you are upfront and pro-active. Waiting till things go wrong, and the LL has to make a decision about rent arrears with no background info is the worst thing to do.
  • Keep in communication with your landlord/agent and tell them what's happening and what you're doing about it. People who you owe money to hate not being paid and hearing nothing. Pay whatever money you do have over to them asap

    Is this really a joint-tenancy and one of your number has sodded off?

    B&t yes a joint t and my 'friend' has !!!!!!ed off!!

    I have been in constant contact with my ll it's not his fault at the end of the day, he has been fab we get to surrender on 1st feb and he will take a charge off our deposit which I think is very fair but he needs the rent for jan I have half and as of the 15th I get paid my expenses so could pay some more/ get a loan from my grandma if my ex housemate doesn't pay up :)

    That bits all sorted it's just the la said I would affect my credit rating for paying late :( evil mean la's trying to scare me :(

    I love coming on here I always get my questions answered so thank you both millions that has stopped me stressing for tonight anyway! Thanks again!
  • I suspect what the agent was getting at was that they were wanting to frighten you about the not-good reference they might be minded to give you for your next tenancy.

    If the landlord has been fab, and that's good to know, why not ask them for your reference if you need one?
