First time advice on Barclays please!

Hi All,
First time posting on here but I have been following for advice and put 2 claims in with Barclays beginning of November 2011. Need some advice please on Claim 2 with the Barclaycard if possible.
Claim 1 - £8500 Barclayloan taken out in 1996 that I had PPI paperwork for and I have just today had £2200.00 paid into my account today as a settlement!!! Result.
Claim 2 - This is for a barclaycard that I took out in 1996 and is still current and I know I paid PPI on this between 1996 and 2006 and have had this confirmed by one of there team on the phone but I do not have any paperwork.
Barclays have somehow messed up and have given me 2 claim references for the same claim and are giving me conflicting information for each reference which makes me think something fishy is going on!!?
I have sent of a request along with £1 for copy of agreement under Section 78 of consumer credit act but when I have chased this they say For some reason I need to resend this again.
Reference 1 - Via letter " we have completed our investigation and have been unable to locate a policy and have not been able to establish if you have a policy and therefore complaint has not been upheld". I then called them and the nice guy said that he could clearly see that I did have PPI between 1996 and 2006 and that he was noting this and would send to the re-open investigation team straight away so wait to hear from them.
Reference 2 - via letter today " We have identified that your application was submitted by post.At the point of applying for PPI, the process required you to select the specific type of cover you required and in this case you positively selected the product.
In addition we have conducted a review of the documentation you viewed during sale. We are satisfied that the documentation presented accurately described the policy and was sufficient to provide you with all the information necessary etc.
As a result we are not able to uphold your complaint and this is their final response.
Conflicting information or what!!
Question is .... Time to reveal they have messed up and are giving me two stories or go to the ombudsman or send off SAR and keep chasing the section 78 request??
Any advice would be very welcome.

well done on your success.
Recently Barclays seem to be rejecting complaints for ppi sold in the 1990s with a range of vague reasons intended to mislead people. There have been several posts like this on this forum in the last month.
I would be inclined to confront them with what they have sent and told you. Ask them what the documentation was and why they haven't sent you the T & Cs. Did they cash the cheque?
Surely if you go down the FOS route they will have to provide this "documentation" rather than a reference to it?
Did they refer to your reasons as to why you think the ppi was mis sold?
They have not got back to me about the mis sale of OD protection on my current account since 1994 in the required 8 weeks. I have had a letter saying they are sorry but not in a position to resolve my complaint.
They are "waiting for records relating to the sale of your PPI so we can reach a resolution".
I have phoned and have been told they are "working on it" Whatever that means! Trying to find a misleading reason they can reject my complaint with, perhaps?
Don't know if this is of any help. Someone else with more experience/knowledge may come along later.

I am glad I have logged on here today as I also had a loan with Barclays which I took out in 1998, I requested via a claim form to reclaim the mis sold ppi and recieved a reply from Barclays saying
"Thank you for your enquiry regarding the sale of Payment Protection Insurance on your Barclaycard.
We are sorry you have had to contact us about the sale of your Payment Protection Insurance policy (PPI). Thank you for taking the time and trouble to do so.
We have completed our investigation and unfortunately due to the length of time since you commenced your insurance cover which was before Barclays became a member of the General Insurance Standards Council (GISC) on 20 November 2001, we have been unable to retrieve any details of PPI charges made to your account. As a result your complaint cannot be upheld.
However, if you are able to provide us with any further information relating to this poilice, for example, the policy number or a copy of the policy document, your complaint will be re-opened and our investigation will progress.

Firstly it was not PPI on a Barclaycard but on a loan which was before 2001, but, I also paid off one loan and took another which also had PPI on it, so this was like a continuous loan.
I never had the policy number at the time as I had lost all paperwork when I moved home (breakdwon of marriage and it probably went in the wrong bpx and top my ex partner) I do have the policy number now though as I called after receiving the above letter and spoke to a gentleman in their Liverpool call centre who gave it to me.
Will it be possible for me to make a claim with just having the policy number?
Should I just write back to Barclays with the policy number and send them a copy of their letter to me with it, or is it too late to make a claim from them?
Any help or advice welcome.

Hi dippyblonde,
I would call the team in Liverpool again and tell them you now have the policy number so can they re-open the complaint for you. If they wont then send them a letter with the policy number, a copy of their letter to you as then you are providing them with the further requested information in writing so they can't argue with that surely.
I would also send off for a copy of your agreement (see template on this site) along with your £1 cheque so that you can get a copy of the documentation yourself and see what it shows.
Keep going with it, you now have the policy number so it is up to them to find the information and whether they were a member of the GICS or not they were still regulated I believe.
