i have a case against my tupe?

    too late now to join a union for this. You have to be a member for so long before you can get legal advice /help.

    There is also a strict time limit on any ET claim for breach of TUPE regs - 3 months less one day.

    Cheers for the replies. When they had the meetings with the new employer(which I didn't attend) they said every thing would stay the same,really friendly ect ect now this has all changed.things like

    Using the company van, no not allowed
    Using the company phone ,no not allowed
    Paying over time for traveling to a job I.e if with have to drive to north Scotland which is over 8 hours away we now have to do this for free,where as the old company paid this.
    there also sending me to work away in Scotland which I never worked away with the old firm .when I told them this they said I have no choice and it's only for a 3 months or so.

    I'am going to get some legal advice and see what they say,but either way I will not be staying long at this firm,one of the other guys who was also got tupe handed his notice in yesterday and the boos said ok thanks,that's it,didn't ask why or anything.

    so they are probably making things difficult for you so you leave voluntarily and they don't have to pay redundancy.

    Your lawyer will need a copy of your contract. TUPE protects contractual terms.
    Debt free 4th April 2007.
    New house. Bigger mortgage. MFWB after I have my buffer cash in place.

    I think your right they have been very difficult since we got there.we do get paid more then there staff which could be the problem but they were aware of this before the tupe. We were told at the start of the sale that the firm had pulled out due to them not wanting to tupe us,so are old firm were going to pay us the reduncey then sell the plant,but then they said that they change there mind and we were on the tupe list.
    The thing is that the work we do is very specialised and you need 12 months experience then attend out a two day corse just to operate the equipment by law. So by forcing us out they would have no one to operate the plant. They have been asking people to work for them as they are short staffed but as they have a bad repution no one will work for them.

    no one gets to "choose" if you are a TUPE or not. Either the work moves or it doesn't!!!
