Item out of stock, can we cancel?

Our washer/dryer packed in a few weeks ago and my Oh ordered a replacement off the internet.

After asking him when delivery would be etc i decided to 'track my order' myself to find the item is out of stock and it clearly states this on the email confirmation we have.

Money has been taken off Mastercard.

There is no estimated date of delivery available.

We really need a washer now and so I don't want to wait weeks for it to be delivered. Can we cancel the order or do we have to accept it now?

You can cancel before delivery and they cant treat it as breach of contract.

Under DSRs, you have 7 working days starting the day after delivery to inform them of your intent to cancel. However doing this, you may be liable for return postage costs if they have informed you of this in a durable form prior to the contract being concluded. Hence, it is better to cancel before delivery and (if necessary) refuse delivery when/if it turns up.

But bear in mind that they have up to 30 days to refund your money, so if you need that to pay someone else for the w/d then you'll have to weigh up whether it's better to stick with the existing order.
