Damage to carpet caused bu faulty paint container - rights?

Hi all,

Over Xmas, an ELC bottle of paint leiterally collapsed over our conservatory carpet. The bottom of the bottle just clean fell through, so we now have a square foot of Jackson Pollock!

We have the bottle still, to show it was a clean collaps and not due to damage or wear and tear, and it's branded ELC.

Do I just write to them 'without prejudice' asking for £200 to cover a new floor or what?!

    Why without prejedice? It would be them sending you an offer without prejudice not the other way round.

    Just write to them and tell them it was faulty, the damage caused and breakdown of the costs and see what they see. I wouldn't expect them to offer anything without a fight either tbh.

    Prove it!

    My point being it might be easier to go via your household insurance. As Arcon say they will not readily admit liability.

    I don't think you'd be entitled to a new floor.
    The best you could probably ask for is some carpet cleaner, or the cost of having the carpet cleaned.
    Sorry if I'm being dumb, but I'm assuming here that ELC is Early Learning Centre's bottles of ready mixed paint, in which case, I've found that Dyson do a fab carpet cleaner that gets it out. :)
