Query on length of service

Hi,

A quick question - what date is length of service calculated? To the start date or end date of the 30 day consultation. My HR advisor says it's from the start but surely it should be the end?

The answer makes a couple of grand difference to me so any advice is gratefully received, even if it's not what I want to hear.

    Your length of service is calculated from the start date of your continuous employment to the actual end date of employment. For this purpose the consultation period has nothing to do with it.

    So they have to give you your full notice and that gets to your end date.

    I've helped Parliament First Anniversary First Post Name Dropper
    There are 2 relevent end dates.

    For notice it is the day you are given notice.
    This determines the statutory notice 1 week per full year.

    For redundancy it is the latter of the termination date or the date that statutory notice would take you to if you don't work full notice(eg pilon).

    Thanks for pointing out that the length of service which determines how much notice has to be given is the length of service at the time of the notice being given. (Clearly I'd been thinking only about length of service in relation to any redundancy pay.)

    Also the length of the notice can be more than "statutory" as the individual's contract may require more.

    Which is relevent if worked or on garden leave through to a termination date and for any payments due for any PILON

    But only statutory notice counts for service for redundancy if terminated sooner than statutory notice.

    The employer is getting it wrong probably trying it on if a few are close to clocking another years service.
