Experience Day refund

Hi,

I'm after some advice on getting an experience day refund.

I bought an outdoor experience day gift certificate for my wife (and myself) a year ago (Dec 2010).

I spoke to the company shortly afterwards and was advised that we should book the experience day in September 2011 as this was both convenient and the best time of year, and so I booked it.

However, come September 2011, the weather was poor and the company cancelled the day. This was no big problem, so we arranged another date in December 2011, but the same thing happened again, cancelled by the company due to weather.

Now that my wife is pregnant, they say we can't go on the experience day until 6 months after she has given birth, which is over a year away (Jan 2013).

I have explained the situation to them (in an email), and politely requested a refund.

However, they say it is "against company policy to give refunds" and have said they will extend the gift voucher until a convenient time (i.e. in 2013).

I feel that it is nobody's fault that we have not been able to go on the experience day, but I feel they are being unreasonable and so intend to argue the case.

Can anyone point me towards any legislation that I can refer to in order to persuade them to pay up.

    they cancelled and then give you rearranged date, which they then cancelled due the weather and now that you have found out your OH is expecting an bambino ( congratulations). i assume you found out after the rearranged December 2011 date they have stated your OH cant go on another date until 6 months after the birth which will take you into 2013, which they are allowing you to use the voucher at a time convenient to yourself and your OH after the bith.
    i think this is reasonable as its not their fault ( well i hope not) that your OH is expecting as this in itself does not stop you using the voucher.

    Assuming there was an expiration date on the voucher, they are doing more than they need to by extending it. Enjoy the new addition to the family, and then enjoy your day out :)
    One important thing to remember is that when you get to the end of this sentence, you'll realise it's just my sig.

    My OH had one (cannot remember what for though) which wasn't refunded after the weather beat her a number of times but the company extended it too. If I recall correctly the T's & C's said once it had expired that was it !

    They were under no obligation to extend so she just accepted that and eventually used it. Whilst at the time she wasn't best pleased it all worked out well in the end.
    Thanks to MSE I cleared £37k of debt in five years and I was lucky enough to meet Martin to thank him personally.
