County Parking update

Received letter today from County Parking informing me that they will prepare for County Court action as I have failed to make payment against the Notice. No further notice will be given.

I "could be liable for all costs and my credit history may also be tarnished affecting any future credit applications". I have 14days to pay £100 (was £40).

Slight problem, I know for a fact my credit history will not be affected, plus I would also need to know when I was going to court (I would have thought).

Your thoughts please.

    I'm preparing to go out. It doesn't mean I'm actually going out though.

    Your credit history would only be affected if they take you to court, they win and you then fail to pay the judgement within 28 days and they get a CCJ against you.

    Carry on ignoring them, unless in the rare event they do actually issue proceedings at the county court. In that case, there are some good people here and also at Pepipoo who will be happy to assist you.

  • All weasel words. You'll notice they never say "we are taking county court action", the proof of which would be actual papers from the court. It's always preparing or intending or may or might with them, all of which mean won't.

    Hasn't there been several successful (albeit small) judgements awarded to these firms recently? So if ops one of the unfortunate few to be subjected to this could loose another hundred quid in fees.

    Only one (Parking Eye, where they were awarded just £15 plus costs) compare that to several recent court cases which PPCs have lost.

    Nope, not that we know of except a strange couple of Parking Eye cases and one of those was only £15 x 2 (the judge threw out any inflated costs as an unlawful penalty and nothing to do with parking management). And a case or two from Haswell at UKCPS (but he lost more!). Apart from that every other case we have heard about during 2011 that actually went as far as Court papers being issued, either resulted in a loss for the PPC or the PPC didn't turn up.

    It really is NOT something to worry about, just getting letters from a PPC is like getting phishing emails, brush them off, ignore them.

    The parking eye case would have been overturned on appeal, as they were awarded what they never actually claimed "the actual losses".
    The Law is quite clear on this, you can not claim for which you have not sought payment.
