Taking Play.com to Small Claims Court...

Hi all,

I need some advice ASAP...

Having sold some stuff on Playtrade before Xmas to raise some extra cash I transferred the sum of £230 out to my bank account which should have arrived within 10 days..

Now since then my Play.com account has been suspended due to them finding some old accounts I had in the past and requiring further verification from myself. I have phone over 10 times now as well as emailed them to ask what is going with my account and funds. In all honesty I am not bothered about the account but more so about the money as I was banking on receiving that money...as I needed it...

The thing is I have written confirmation via email that the funds were on the way to me!!

The Indian/Phillipino call centres keep on fobbing me off...and am the end of the line with calling them and wasting my time.

Please could someone advise me as what I should do ASAP....as I am stressing...because of lack of funds...:(

These old accounts, what exactly is wrong with them or happened to them for play.com to be questioning it?

Do the terms and conditions in playtrade allow for this?

Could the old accounts be in arrears, in which case there is probably provision to clear outstanding arrears before settlemment? Can you find copies of the terms you signed up for anywhere? May shed some light on how successful your court case is likely to be.

You're still a way from a court case. You need to find out what's going on first. Have you tried contacting them other than by phone? Writing to their head office?

Play.com are based in Jersey, so AFAIK would not be covered under English laws and our small claims court.
Additionally there may be differences between business and customer rules.
