Having problems getting PPI returned before 2005 from HSBC

I have just received my first letter back from HSBC in relation to PPI on my credit card with them and they are saying that "we are only required to retain information on your account for the last six years. If you are able to provide statements showing PPI on your account for the period prior to our records, please forward these to us for consideration."

I can't beleive that HSBC only has records that go back 6 years. Unfortunately, I haven't retained all my statements since 1998. I called HSBC to ask when I first acquired the Credit Card and they told me it was in 1998, which I believe is the same time I took out the PPI. HSBC has only offered a refund of PPI from February 2005 to August 2011 which happens to be 6.5 years to the exact day.

Does anybody out there know how to handle this situation? Is HSBC really only required to give me 6 years (or in my case exactly 6.5 years) of PPI back? Is there some statute of limitations that I am not aware of? I do know that MBNA gave me PPI back to 1998, so why can't HSBC?

Also, f I try to fight them, is there any way they can recind the offer that they already gave me?

Also, can somebody tell me how this is calculated and if they should show me since they haven't shown me the calculation of how they came up with their offer and neither did MBNA for that matter.

    Why not? The data protection act is very well known and the 6 year timescale has become almost universal and has been for some time.

    Nowhere to go I'm afraid. If you cant provide statements and they dont have them then there is no evidence to show if or how much PPI was paid.

    If that is all the information they have then yes.

    Nothing that would help or hinder you here.

    In theory yes. However, it is unlikely. That said, what do you intend to present as evidence to fight them? (other than the statements you have but that isnt fighting them as they have asked you for them)

    It is refund of premiums paid plus interest.
