I've called the police on Capquest

...I'm getting 3 phone calls a day from Capquest, each time asking me my address, refusing to confirm anything with me unless I 'prove who I am' (they called ME! who are THEY!?). I managed to ascertain which customer I'm supposed to be in debt with (I'm not, I called them to check) and the address I'm supposed to live at (I don't and never have lived there) but still, even after taking my home (my dad's) address off their system, still keep calling my mobile any time between 8am and 8pm (I work shifts so they wake me up then call me at work at least twice).
The police have given me a crime reference number for the harrassment and are taking a statement tonight and will be speaking to their phone provider also (unfortunately my network operator cannot block Capquest's calls individually).
Does anyone know how many phone calls in a given time is classed as harrassment and do I have a case if I sue?
Thanks all

I don't know about sueing, but make sure you get something for the grief they have caused. Oh and make sure it is something you want, not something they happen to have lying aroundOfficial DFW Nerd Club - Member no. 208 - Proud To Have Dealt With My Debts DEBT FREE DECEMBER 2008!!!0

I'm assuming you have made an arrangement with them to pay?
Its probably best to put in writing your proposals to pay, and that you are not prepared to discuss this by telephone as it is causing you distress and to please conduct all future communications by mail. Keep a copy for the police.0 -

My reading of the original post for this thread is that this a case of mistaken identity."You were only supposed to blow the bl**dy doors off!!"0 -
Three? Is that all?
I had MBNA phoning me 22 times per day and I couldn't get a darned thing done about them and it went on for more than eight weeks.
They have to ask your name and address because of the Data Protection Act, by the way0 -

my fault sorry - In which case I'd write a letter informing them that you have contacted the police and to please remove you from their list IMMEDIATELY or you will have them reported to ombudsman/FSA and will be seeking damages.
Send it recorded delivery so you know they get it - sometimes it seems a letter is the onlything they notice.0 -
I might be barking up the wrong tree but this is setting alarm bells ringing If you havent lived at this address and are sure you dont owe them or know who they are has someone stolen your idenity ????

Sorry, should have been clearer. I KNOW someone stole my identity about 5 years ago. The bank she stole from wrote off the debt as fraud. Capquest are chasing me for a debt SHE wrote up and registered to an address I never lived at (everything about the debt apart from my mobile number is wrong).
I've written to Capquest asking them to stop calling me and asked they check with their client that the debt is mine (as they have already confirmed to me it is not). Capquest have ignored all letters, recorded or not.
3 times a day might not sound like a lot but I work 10.30 - 7pm. I'm getting calls at 8am, 3pm and 8pm. So it wakes me up, bothers me at work and as soon as I get home from work I get another. I use the mobile for work so I can't switch it off and my mobile operator can't block it as the network doesn't have the capability. They are absuing me and asking for my address - even if I wanted to discuss it with them, I can't confirm an address I don't know!! They gave me the first line and it meant nothing to me! (Which is in breach of data protection anyway)
I don't owe a penny and I'm being harrased 6 days a week. I've been spoken to like dirt by that awful company, I've done everything I can, the bank have written it off and closed the account and refuse to speak to Capquest, Capquest won't speak to me about it, or call RBOS (the bank)...I'm stuck!
So the police seems the only way out - they certainly think I have a case, wish me luck !!0 -
How about bbc watchdog or something similar? Even a local radio phone-in might like to get its teeth stuck in? Have you written to the MD of Capquest? Better still, I'm sure we can get his/her mobile number somewhere and continually call them?Official DFW Nerd Club - Member no. 208 - Proud To Have Dealt With My Debts DEBT FREE DECEMBER 2008!!!0
