a bit of advice please ;0)

hi im in debt to the tune of £28k spread over twelve creditors ive contacted cccs and am waiting for them to call tomorrow i had decided to go bankrupt so i cancelled all my dd to creditors so i could save for the fee. having looked again at my finances i have decided to bite the bullet and pay it all in three years. This is doable if i cut to basics im a bit scared to post my soa as im on sickness benefit and some people can be judgemental, i cant work as i have a severe mental illness and a back injury from when i broke my back due to osteoporosis. I would give my right arm to work, i hava a degree in nursing that i cant use due to my disabilities.

My problem is this some creditors havent got in touch for years and i have no correspondance as i used to put these in the bin should i contact them or wait for them to contact me?

My plan is to pay of my debts through saving for f and f settlements which hopefully my creditors will accept at the moment im paying no one, or should i just snowball them v confused lol. ive made a start and have paid off provident in full freeing £108 per month and i will pay off my £600 overdraft this month. I have about £700 disposable income to throw at debts how best to spend it?


If i enter a dmp can i still use my overdraft ( i wont go into it but its nice for just in case.)?
Ive waffled for long enough now thanks in advance,

    Harri,

    Find out when these agreements defaulted. If its over 6 years you can push for the statue of limitations. This way it may reduce some of the creditors you have to pay.

    Speak to Payplan or the CSCS and they can give more advice on the overdraft and the rest of the debts. There is a link to the open area

  • Also I don't think people will judge you for being on benefits, post your SOA and most people will just want to help you cut down your spending and help you become debt free.

    Hi

    Are you aware that debts that have not been paid or subject to written acknowledgement are statute barred. If CCCs writen to them a week before they become statute barred, then they become live for another 6 years?

    it would be wise to find out what their status is before speaking to CCCS.

    if you have a DMP, you cannot use an overdraft. You need to speak to CCCS and ask them to reduce your paymwent that month.

    Also CCCS will not do full and finals for you. You may be better doing them before you start a DMP, if possible.

  • Please dont be afraid to post, I was on SDA for 14 years and am now back working, its very frustrating but there is loads of great advice and helpful people on here. Although I would be pretty rubbish at looking at our soa hence why my debts are so high there will be lots of help on here. You probably due to your health have a higher expenses in some areas on your budget, on ours we have £240 in petrol every month but without my car my children would not attend school or me work, we also have lots of hospital appointments etc. This has all be noted the reason why for our creditors to see.

    Christians Against Poverty are a marvellous organisation who would be able to help you talk to your creditors and make affordable arrangements with them all. 8-)

    hi all

    how do i find out if something is statute barred

    my oh had a debt many years ago and basically since then has had a breakdown and been really ill

    he ignored the debt for years but then for some reason sent a £1 off (cant exactly remember what for ...info perhaps but i can remember that he put on the bottom a note to say something so it didnt revoke the potential statute barred coming into force (sorry not very helpful)

    can anyone help

    Best get a copy of the credit file and check when it was applied. Should be £2. You only need to get the writing bit not the score. Find out when it was done, however if you made a payment they still come after it.

    What was it for wilf? Maybe a prove it letter would be better

    thanks cam it was halifax overdraft and subsequent charges overdraft ran up during start of illness back in around 1995 ish passed through to rob..... way years ago

    Hi Wilf - I guess the £1 was for a CCA request and those templates state that the money should be used only for that purpose? (that said if it was for an overdraft then a CCA request was not relevant as overdrafts are not covered by the CCA.)

    Roughly how long ago do you think he stopped paying the debt?
    Can you recall roughly when the £1 CCA request was sent? do you still have a copy of that letter?

    What is the state of the debt at the moment? have they been chasing at all?

    If he likely stopped paying in around 1995 then its very likely that the debt is statute barred, however if nobody is chasing him then I would simply do nothing. If RW or another debt collector are chasing then we can help with templates.
