MBNA claim rejection

I have just received a letter from MBNA rejecting my claim for my PPI payments to be refunded. They state that when I opened the account in 1996 that I ticked the box for PPI.
Several times I phoned to cancel this and was told because of the level of credit I had (£14000 - even though I never used this amount) that it was necessary to keep this on even though I have never claimed or defaulted on any payments.
They had said my claim is not valid and that is the end of it. I have the FOS forms but wondered if I should write back to MBNA and threaten legal action?
Any comments/ideas please

What would be the grounds for legal action?
What evidence do you have to back up your accusations?
Remember that having PPI is not unlawful and the onus is on you to prove wrongdoing. The courts have not been anywhere near as generous as the FSA/FOS routes. Even the likes of Black Horse have been winning in court (And leaving those people with the court costs). However, ignoring all that, you would be timebarred.
If you disagree with their response you should now refer it to the FOS. It is free of charge for you and the FOS is more consumer biased than the courts. You need to give you reasons and any evidence to support your case. Verbal accusations dont carry much weight. So, try and back it up with dates, times and names of the people you spoke to or give copies of any letters you wrote requesting the insurance be cancelled.I am an Independent Financial Adviser (IFA).
