Preparing for Employment Tribunal.

Hi guys.
Mine and my OH's tribunal date is in a couple of weeks, and we'd like a bit of advice about preparing for it.
Firstly, we haven't received any copies of our ex-boss's ET3 - is this normal?
In fact, we haven't even been told if he responded at all.
Do we have to take copies of the evidence that we sent to the ET?
Or prepare a statement?
We've been waiting to hear about a new date for our combined case, hence why we haven't rung the court up for advice - their letter only came yesterday.
TIA.

You need to cntact the tribunal office and ask then what is happening. By this stage you should have had a copy of the ET3 and arrangements should have been set for the exchange of evidence bundles and copies for the tribunal, which should have included your witness statement(s). The fact that this hasn't happened is a matter of concern.0

Thanks SarEl.
Thankfully we have everything organised here document wise, but the fact we haven't been told anything by the court or even ACAS is now a worry.
We assumed that we were going to get a default judgement because the ex-boss hadn't responded based on the fact we haven't received/heard anything.
So to get a date for a hearing was a surprise.
As for the bundle, can I pass the following by you?
After reading through some threads on here I'm assuming that we need to have a folder with everything in chronological order?
Are copies sufficient or should they be originals?
I know that I can get this information from the court when they re-open, but we are both mature students with a lot of work due for submission the same week as the hearing and I'm stressed out already about what needs to be organised - it's final year for us both, so it's thesis time.
Thanks again SarEl....was hoping that you would nip on and post.

You need 5 folders! But yes, copies and in chronological order, paginated and with an index of contents at the front. This is normally done by the employers side - that is why I am surprised. It may be that there is a default judgement in the offing and the reseving of the date is a formality. But I am only guessing what is happening and you do need to speak to the tribunal office to find out what is going on quite urgently.0

Cheers SarEl, you have put my mind at rest for the rest of the day.
Considering how inept the guy is, I would be very surprised if he has responded.

Well I spoke to a lovely man at the tribunal office, and he said that our ex-boss hasn't responded to anything that they sent to him.
We still have to attend the hearing and just have to take everything that we have sent to them already - wage slips, contract etc. - he never mentioned a bundle.
I'm still confused as to why we need to go if he hasn't responded, surely that would result in a default judgement on our part?
I only say that after reading it on the ET website.
I should have asked him but I was pushed for time, forgot and the office had closed by the time I had the opportunity to call. :mad:Stone walls do not a prison make, nor iron bars a cage.0 -
It's easy - a default judgment is still a judgement! Don't stress about it - just do it!0

Thanks Sar, you really are a godsend...hope you realise that.

How does it work with getting the ex-boss to pay up what he owes?
Does he get told to pay it directly to us, or does he pay us via the court?Stone walls do not a prison make, nor iron bars a cage.0 -
You sound very organised. I anguished for ages about whether to post a link to my 'threadIthinkwouldbeausefulsticky' but eventually decided if I were you, I'd like everything I could read

I am also waiting for a Tribunal which is being held in a few months and my former employer has issued me with ET3 and folder with everything in it. I am so nervous as representing myself as cannot afford a solicitor, esoecially if I lose the case another bill would cripple meYou need to cntact the tribunal office and ask then what is happening.
