Bought top for hubby-shrunk 1st wash-seller refusing refund?

Hi all, wondered if you could help please.
I'm unsure to my rights....
I bought a top before xmas for my hubby from a seller on ebay, arrived lovely.
Hubby wore it and fitted great.
I washed it on 30degree delicate worn once wash and tumble dried low/cool for 10 mins before air drying. The label stated wash at 40 degree and tumble dry low (no time stated ).
When hubby went to wear again it had shrunk in the wash. I contacted ebay seller although very polite, they point blank refused a refund ( wanted replacement but they didn't have any), saying it wasn't faulty. I believe it is faulty or else it wouldn't have shrunk. Seller has refused refund through ebay and I have now escalated to a claim to see if I can get anywhere that way. If I had done this and bought from ashop I would just take it back, but obviously the seller has to agree in this instance.
I have spoken to ebay and they say I am well within my rights. He says he has spoken to ebay and he can refuse a refund, so i'm completely confused.
Does anyone know what my specific rights are please?

If it was bought within the last 45 days you can claim a SNAD against the seller
You will be asked to return tracked at your own cost to the seller, ebay then should issue a refund even if the seller does not agree0 -
As said above, you can return it within 45 days.
Make sure you don't delete any e-mails, everything is done via eBay and I would probably lodge it through the Resolution Centre. That way, you have yourself covered on most bases.0 -
Thank you both for your answer. Yes we are now going through the resolution centre and although trying to sort out, I have now suggested ebay deal with it as we disagree on the outcome.
It was bought on 13th Dec, so well within the time frame.
