    Remember to remove the notice of correction after its all sorted out as it causes credit applications to be referred

    A Capital One account was linked (on the credit report) to my wife's name last year. The name on this account was the same as my wife's, but with a different middle initial.

    The address for this person is in Essex, over 50 miles from where we are.

    I'm guessing this person in Essex is the same person with the Capital One account.

    I think the default for the Cabot account has only been added to the report in the last few days. This is a particularly !!!!!! thing to do, given my wife wrote to Cabot to say she had no knowledge of this account.

    Does anyone know what info a company can see on a credit report?

    If they can see that a name is different (even if it's a middle initial) surely they must know they're on a sticky wicket?

    Can anyone suggest how we write a Notice of Correction of the credit report?

    I'm reporting this whole episode to CSA.

    Once again, your help is greatly appreciated.

    The information needs to be erased, a notice of correction is not needed unless your wife wants to apply for credit soon. Concentrate on having the incorrect information removed. Don't forget to check the callcredit report too.

    My wife has received another letter from Cabot. It stated that this was the last opportunity to agree a suitable repayment plan before it's moved to the Pre Litigation Dept.

    Just to recap, here's what we've sent to them so far.

    1st letter http://www.moneysavingexpert.com/attachment/3rdpartydebtsletter.rtf

    2nd letter - She explained that having read her credit report, she had wrongly been linked by a different company (who I've also sent a letter to, asking for this link to be removed) to a person with the same name, but different middle initial. She also asked for the incorrect details to be removed and that she would report them to the CSA if this was not removed within 7 days.

    We haven't yet written the notice of correction. Should we do this now?

    Can anyone advise us of the next step?

    How can we prove my wife and this woman are not one in the same?

    Can we threathen to sue if this is not resolved promptly?

  • Have you complained to the CSA yet? Although you have not long waited for a response if you can complain to the CSA then they will usually get Cabot to action your issues faster. Are you or your wife planning on getting credit soon? If not a notice of correction is not as needed. However, you can ask for a notice of correction to be added at any time just stating that your wife is not in any way linked to the debts in question - due to mistaken ID.

  • Well you can contact them ask to speak to a supervisor state that this is causing excess stress and as you have had no response and are still receiving letters you are taking this matter to the CSA. You will also be considering action under the Administration of Justice Act 1970 for harassment. Remember to write down the date time of call and who you spoke to.

    Hopefully ours may be coming to an end.

    They asked for proof of where my wife was living at the time the account was opened eg. Utility bills & driving license.

    She's sent them copies & demanded they take the default off her credit report.

    She hasn't yet reported this to the CSA, but she will if they don't sort this out.

    We haven't yet had a reply from Capital One. They were the ones who initially linked the address of this other person with my wife. Does anyone know a telephone number we can reach them on?

    For those who have read my Cabot problems in other posts, apologies.

    To cut a long story short I wrote ten letters to Cabot re a default on my account and got nowhere, not even a response from them. I took it up with the Information Commissioner and it got sorted. Now, the ICO is always busy and it did take five months for them to engage but once they did it was resolved in a matter of days.

    Cabot should be shut down in my opinion. They're not interested unless you are paying them money. The CSA is a voluntary body isn't it? Whereas the ICO and OFT are not.
    Never argue with an idiot. Especially not this idiot because I'm always right anyway.

    Thanks for the reply. Could you let me know where your posts are & I'll have a read through.

    My wife received a letter from a credit card company which she has, but doesn't use anymore. It stated that following a review of her account, they would be reducing her credit limit by around 90%!!!!

    I now realise this must be sorted ASAP.

    I'll look into the ICO. I was also thinking of writing to our MP, as this truly scandalous.

    My wife has still not had any reply from Capital One at all. We are still waiting for a reply from Cabot after she sent proof of where she was living at the time the defaulted account was set up.

    Capital One are the main culprits here, as they initially linked my wife to the other lady with the different middle initial.

    I assume financial institutions can see all the information that we can see on a credit report. If it clearly states where someone has been living, how long they lived there and previous addresses & dates, how on earth can they link someone who lives about 70 miles away, just because they happen to have the same first & last name.

    I wonder if it's possible to claim any damages over this? One wonders if a financial penalty would make these companies a bit more careful how they attempt to claim money owed.
