unsigned cheque

i sold a 2yr old dog and when the buyer left the house we noticed cheque was unsigned, it was too late he had gone, we have attempted to get another cheque or bank transfer or cash but he keeps promising payment, are we allowed to go and get the dog back, we signed over all kc papers and microchip, we still have the unsigned cheque, is this illegal and what can we do? thanks

i would write a letter (sent recorded signed for) saying that if payment isnt sorted with 7 days court action will be actioned for the money owed,
im sure someone will tell you exactly what u need to put in the letter0 -

On a totally unrelated subject:
Cheques are rarely checked against the specimen signature.British Ex-pat in British Columbia!0 -
^^ which is all very well (not to mention illegal) but should the cheque bounce, it's not going to be easy to take them to court and used a cheque with a forged signature as evidence.0

....that and the provider could say to the bank that the cheque was not signed and therefore the op gets done for fraud as well as no money for the dog.
I would start by doing a letter before action....then follow it up with the money claim...0 -
Contact KC they at least might be able to put a stop on the transfer. Sorry, I know it doesn't help with the cheque.0

If your quite happy to travel and get the dog back, just travel with the cheque and get it signed.make the most of it, we are only here for the weekend.

You're brave if you give goods to someone with an uncleared cheque in return. I always make sure any cheques have cleared before releasing goods, I'd probably do this in future.0
