PPI Missale

I am trying to claim back PPI on a loan I took out with Santander over 3 years ago. I started my claim in July 2009 well before the Judicial Review, Santander have rejected it and I am now with the Ombudsman who in fact also rejected it but I went to appeal, how can they reject it when I never asked for PPI and when the Advisor rang me I told him I did not need it as I worked for Local Government, can anybody offer me advice as I have just received another letter from the Ombudsman saying it may take another year!!! It seems so unfair as many banks are just paying out!!! Please help:(:cry: Mitmit Liverpool

    Just curious, if you didnt want it, and told the adviser that you didnt want it. You must have signed for it when the loan was taken out,
    why didnt you question it at that time and subsequently when the payments were going out.

    The ombudsman must have told you why it has been rejected so what is the reason they have given

    The FOS give you a written response as to why they reject your complaint. So, what was the reason?

    If you never asked for it, then why do you take it out? Why did you not complain earlier?

    There are not many ombudsman and they have to deal with a large volume. I have a case in front of an ombudsman that was referred to them from the adjudicator 2 years ago and is only now being sorted (not against me but a complaint I helped someone make)
    It seems so unfair as many banks are just paying out!!!

    Some of the banks have rolled over very easily now and have gone to the opposite extreme by paying out when they could easily reject them,

    Pressure sales are allowed and it is not a reason that you see people being refunded.

    All you can do is wait the actually "proper" ombudsman peeps as opposed to the initial advisors-who it seems to me just try to negotiate between the parties, are very busy as Duns said. There aren't that many of them and there are so many complaints.

    Remember if you get sick of waiting and/or the ombudsman finds against you, you still have the option of court action. I find the CAG forum better for info if you are going the court route and it involves initial costs, plus you have to be very sure of the legal arguements. So if you are interested in finding out what is involved checkout the PPi forum over there.

    Most of the banks seem to be accepting that these sort of policies were systematically and on mass miss sold as we all know and are paying up especially once the FOS get involved. But Santander have always been a bit awkward and seem to be one of the few that want to drag things out-given their size and the numbers of PPI policy miss sales they will have inherited from all the other financial institutions they have bought out it no wonder they are dragging their feet.

    Opps reread and it would appear the ombudsman rejected you and its an appeal? Have heard they take even longer sorry.

    Lookinbg at the date you took the loan out are they rejecting it because it was after the initial reports about PPI miss selling and was when some of the rules and guidence had been tightened up?

    Most of the claims you see on here and other forums are usually pre 2006/2007, during the ninieties and into the noughtis these policies were miss sold as a matter of course, but once things started to be questioned in 2007/2008 the FSA issued new guidence.

    I wonder if its the fact it is so recent, so the ombudsman assumes by that period the advisor would be aware of the need to show due care and consideration when selling these types of policies.

    Worth a check for any older policies as they are an easier claim because of the era they were sold under.

  • Thanks Ali, when I spoke to the Ombudsman they just kept asking if Santander have been in contact with me, I think they know its mis-sold otherwise they would have rejected it completely, and I know many people from Local Government have been paid out because they already had insurance. At the time I needed the loan desperately but the Advisor indicated that if I did not take the PPI my chances of getting the loan were virtually nil. Even though as a Local Government worker I would be entitled to six months full and six months half pay if off sick why would I agree to PPI if I did not need it? Pressure!!!!!!

    If you were so adamant you didnt want it and said so why did you sign to say that you did want it.

    Pressure has nothing to do with it. No one was holding a gun to your head and I presume you were an adult.

    Between your OP and post 7 your story has changed dramatically.

  • Did you really work for local government?

    I have seen cases where in reality the complainant was actually employed by an independent organisation contracted to carry out the work.

    And for a person that handles complaints, seeing such changes would make them more likely to reject due to inconsistency and unreliability. Some things can be forgotten and then recalled later but outright changes are harder to justify.
