Making a return when the goods are not faulty

Hi,

My brother has managed to buy a toy twice (bought one, then saw it somewhere else cheaper) with the intention of returning 1 of the unopened items for a refund.

He bought the toy (a live action dog thing) from Beales, still has the receipt and it is still unopened - they have just told him over the phone that they would not accept the return as its not faulty. Surely if he bought it yesterday, he should be able to return it for a refund without issue?

    You have no statutory right to a refund when purchasing goods instore if you change your mind. Many stores do allow returns within a specified period -- but this is not a legal requirement and something you need to check before purchasing.

    Legally? No, unless he bought it online.

    It is down to the shop policy and the shop policy alone.

    Your brother may have more luck if they actually pop into the store and have a word with the store manager.

    If they explain what happened and say that they know they are not legally entitled to a refund but would they consider allowing an exchange.
    This might work, especially if they get something a bit more expensive and pay the difference.

    As others have said, there is no statutory right to return an item where you've bought something in store but changed your mind.

    If you bought online though, Distance Selling Regulations will help you, as you DO have a right to change your mind.

    However - do check if the store displays an additional returns policy - if they do, and you meet the eligibility criteria (ie how long it's been, not an excluded item etc), you may be able to return it - but would expect it to be only for a gift card / credit note.
