Do Sitting tenants have the right to own the property?

I know some sitting tenants who have been in the property for over 25 years - the land lady passed away - are they now the owners of the property? When they pass away, would it be inherited by their beneficiaries?

    usually it reverts to the landlord, there are exceptions. I think that if a family memeber has lived there for over a certain number of years they may have the right to acquire the tenancy.

    To give some kind advice to your question more information needs to be forthcoming.
    How long has she been dead. Have you be asked to pay rent from the executors of her estate.
    Do you have a tenancy agreement in writing.
    When was the rent last payed and is it a fair rent and to how, just some of the questions that need to be answered.

    i doubt they are the new owners, but, depending on their lease, they may be allowed to continue staying. Assured tenancies are pretty well bomb-proof in terms of getting tenants out. I suggest they go to a solicitor with the tenancy agreement (no matter how many years ago they signed it) - first half hour is often free - just ask.

  • What happened was that the land lady passed away and nothing was done about the house...they just stayed there. I heard that if there stay and ownership of the house remains unchallenged then they become the owners of the house after a period x. Low and behold, I checked the deeds online and there names are on them!

    Unless you believe in the deeds fairy, someone must have staked a claim and registered them as the owners!

    an estate agent told us that these people in question were sitting tenants. the problem they have caused is that they do not take care of their house and its a right dump, which has under valued the houses to either side (theres a rotten van, broken windows, rusty scaffolding, empty beer cans etc). nothing can be done in terms of getting them to clean up. its like living next to a dump yard.

    It goes to the Crown. I guess it would then be sold at auction with the revenue generated going to the public purse.
