DLA - HB Claim

I am a Private Landlord and I have been approached by some of my existing tenants about one of their relatives - she is a 26 year old single girl who is claiming DLA - I believe she gets around £85 a week or so.
She is currently trying to claim ESA and is going to a tribunal.
She has been in the UK since 2008 and her claim for DLA started in October 2010 and holds a Cypriot Passport
Before I enter into any kind of agreement to help house her - is she entitled to claim HB (LHA) and at what rate - say prior to 31.12.11.
Someone else I spoke to said she should be claiming IS (or a form of it)
Any help would be greatly appreciated

from next year lha will be paid at a lower rate for those under 35 so year,so you need to talk to the local council about that,if she is going to claim esa then she cant get i/s as well,lots to think about0

What I mean is can she claim some form of IS until her ESA Claim is decided at the tribunal0 -
She should be able to claim the assessment rate of ESA whilst appealing0

It isn't your concern. Your sole concern should be whether or not she can pay the rent, not where she gets it from - that is her problem.
I suggest that you do not get involved in that at all other than answering any questions the council ask you if she does put in a claim.0 -

This may well affect her, unless she qualifies for the severe diability premium, in which case it won't. We know she is on DLA - if she gets the middle rate of care, she has no non-dependents and no-one is getting carers allowance for her, she'll get the higher rate.
And of course, if she has a non-dependent she'll qualify for a 2-bed rate anyway....0 -
I specialise in renting my properties to the benefits sector of the market. In most cases things are straightforward - this particular case was not 100% clear - and beyond my knowledge.
This is also confused by the fact that 'Capita' are in the middle of things assessing the claim and some of their questions in simple cases are bewildering to say the least!
Further confusion from that the fact that her English is very limited - and in my limited medical opinion has learning difficulties (sorry if thats not the politically correct term)
It is only the fact that her relatives have been exemplary tenants that I am even bothering to get involved in a non standard claim.
I will investigate further next week
In the meantime I appreciate all the answers....0
