    Below is what I sent them this afternoon and below is their reply

    NOTICE OF CANCELLATION
    Under the Distance selling regulations I wish to return one set of "ghd Scarlet Deluxe Collection Set " which was ordered on 21st December and was received on 22nd December.
    This is as per paragraphs 3.22 onwards on page 17, and paragraphs 3.46 onwards on page 25 of the OFT's guide to the DSRs
    As well as point 10 - cancellation rights within your own terms and conditions.
    As I am sure you are aware, as a customer I have seven working days to cancel this item which gives me until the 5th January so I am well within the timescale.
    Could you please let me know when you will be collecting the goods, alternatively if you give me an address to send them to I will deliver them to you.

    You need to include a brief covering letter, stating your unique returns reference number ****** order number and the reason for return. Without this we will not be able to complete your return and this may result in the item being sent back to you.

    Please obtain proof of postage, this is a free service offered by the post office and will act as your insurance if the item is not received back with us. Without this we will not be able to send a replacement to you in the rare event that your item is not received by our warehouse.

    To me it looks like they are still going to send them off to GHD for repair. What should I do now. Keep the product and send a letter or send them back with a covering letter?
    Why cant things be simple!




  • As people have previously stated (by bod & unholyangel), you are in a much stronger position by invoking your rights granted by the Sale of Goods Act.

    Goods are faulty upon delivery or just after. Reject the goods (as not of suitable quality) for a full refund.
    They would also be liable to cover the return postage.

    Both SOGA and DSRs should work equally well in this situation.
    Especially as they have supplied a Freepost return address.

    Op, you appear not to have told them that you are expecting a full refund of all monies paid.

    From your latest email, could they reasonably assume you are returning them for repair?
