Outstanding Wages + Holiday Entitlement

Please help! :(

In a nutshell I walked out of my job on the 27th November and haven't been back since. My employer suspended me on full pay and arranged a disciplinary meeting for the 1st December but I did not attend. They re-arranged the meeting for the 5th December but again I did not attend. I received confirmation of disciplinary on the 9th December which states that my employment has been terminated.

My problems are:

1) A payment of 36.5 hours which I had worked before the 27th November is still outstanding.
2) I have still not received a P45.
3) A payment of my holiday which I had accrued is also outstanding.

I have raised the issue with the company's HR officer who has assured me that the matter is being dealt with and to expect full payment of any outstanding monies today (30th December 2011) but I have still not received anything. I have kept a record of telephone conversations and all written communication as a precaution.

Am I entitled to this monies?

Am I just being messed about?

How can I pursue this further?

All help and info would be extremely welcome

    if today is normal pay day I'd expect it to be in the bank by opening time. Post again at 9:30.

    well, if you do go to court they may in turn sue you for losses incurred as a result of you just walking.

    do you think a simple email asking where your money is might do better?

    Sod the legal position, I think you've got a bloody nerve.

    You walked off a job without notice (clearly under threat of disciplinary action which you believe would have been justified), so technically you are in breach of contract. You then messed them about twice by not turning up to disciplinary hearings. The employer would be quite entitled to come after you for the legitimate costs incurred in addressing your actions. Sending a letter such as this will virtually guarantee they will do that, if they have any sense at all, and I hope they do.

    However, to the OP, was their a genuine reason for working out you couldn't rectify? bad behaviour on the employers part or something? it might help your case

    Personally I would forget talk of cases. The employer clearly has no intention of not paying. They said it should be in your bank on 30th - not that it would be. If they actioned it immediately at 12:10 on the 23rd (from HR - not payroll - and HR can't make a payment!) then getting it into your account by 30th would have been a pretty tight deadline, and that is asssuming that payroll can simply make a run just for you - which many can't. Ask the question by all means, but you are jumping the gun threatening legal action, and you may just make matters worse as others have suggested.
  • Tbh I agree with everyone who has posted above. You are in breach of contract, and frankly it's not very sensible posting on a forum anyway. If you feel serious about this you would be in a solicitors office right now consulting with them, however you are not. Also, can you really expect much in the way of sympathy after walking out of your job.. you walked, you weren't pushed on a forum based in a country that's suffering a 3 million unemployment rate, debt and economic downturn.

    If you were suspended on full pay, should you not be paid upto the date your employment was terminated (5th or 9th December).

    You seem to be asking only for the money upto when you walked out - 27th November.

  • I was paid hourly. As I did not work any hours during my suspension I wuld have not earned anything, therefore I am only pursuing the hours I worked before my suspension.

    Very noble of you I'm sure.

    What were you charged with that made you resign so suddenly?
