Credit Card refund for lost online purchase?

I purchased some goods online value of £30 using my credit card. I was notified that the order had been despatched on Dec 16th. The goods never turned up. I have sent a number of emails to the company informing them I have not received the goods, no reply received.
Would I be covered for claiming the money back through my credit card company?

Section 75 only covers purchases over £100 - but it's worth asking anyhow.

The royal mail can take up to 15 working days to delivery the goods if sent via 1st class or recorded delivery.
This is the busy time for royal mail.
If you can change the policy of royal mail will help everyone.
Otherwise seller can not do anything until 15 working days have passed
I am sure you will try to get the refund before 15 workings days have passed if your plan is to get free goods.

Don't know how to take your comment? I am not after free goods just what I paid for and never received!

The royal mail make the seller to wait 15 working days before item is reported lost.
The seller got no control over this.
May be you can ask the royal mail to change the policy from 15 working days to say 3 working days. This will help everyone.
In your case it is not been 15 working days. What part is difficult to understand?
The reason you are going on about this before 15 working days is because it seem you are after free goods. Sad if you ask me. Otherwise you know the policy of royal mail.

You are the sad g*t. I am in no way after free goods! If the company responded to my emails there would be no problem, that is the only reason why I am checking out what options I have for a refund, that is if it is necessary.

Yes, eventually. ie if they haven't turned up after a 'reasonable' time bearing in mind the time of year.

The fact that your attempts to contact the company are proving fruitless will only strengthen your case (don't forget to keep copies of the emails sent).

You'll need to ask your card provider for a 'chargeback', but be aware there's a 120 day time limit for such claims.

Goodman, what a load of rubbish; this suggests more about your mindset than that of the OPs for you to make such a ridiculous assumption. I too would have emailed them by now, and then maybe enquire about how to go about a refund if needed, which is what this thread appears to be.

Jazzy, does the company have a telephone number? Might be better to call and speak to someone. Under the sale of goods act the seller has to be able prove delivery of the goods. However, given the time of year, it might be advisable to also call the delivery office and see if there's anything there for you to collect.

Edit: Sorry, not sale of goods act. Distance selling Regulations. Left my brain on the pillow this morning I think :)

  • I had a recent similar incident with an item costing under £10.

I ordered in plenty of time (Dec 11th), by the 20th, nothing showed up. I contacted the seller who said they'd had technical issues and that my item was definitely dispatched.
I responded, asking when they thought it would arrive and whether they had sent it first class (hoping to get it before Christmas) and nothing. I emailed them 3-4 times, nothing. I emailed the MD, nothing. I phoned them, and the line just beeped.
I then sent them an email saying "if I don't hear by COP today, I'll be contacting my credit card company with a view to refusing payment" and a refund magically appeared saying that the item was out of stock (amazing, as it is still for sale on their site, and they had told me they had dispatched it! - I smell porkies!)

Capital One took it very seriously when I mentioned it to them and sent me a letter and form - requesting all details about what had gone on, and reassuring me that if the seller was in the wrong that (as long as I kept up my payments etc.) I would receive a full refund for the item and any costs/fees associated with it.

Since the item has been refunded, I wont proceed. I'll just order it from someone else now.

I hope this reassures you a little.
