Exceptions to the right to cancel

The sticking point is whether they accept it was sent unsealed, and so was not unsealed by the customer. I'm not sure where the burden of proof would lie in this case.

Could be worth the OP giving notice of cancellation to the retailer within 7 working days and then arguing it out with the retailer later. Question is, does this particular boxset come sealed (taking into consideration the above post)?

Box sets are never sealed when I have bought them before from Amazon and hmv online. Just to add my 2 cents.

*looks in cupboard at the blu ray box sets bought from amazon this month*

    Every one sealed.

*looks in drawer at the xbox games bought from amazon this month*

All bar the one I have played is sealed...

The only thing HMV did dodgy to me was sell me a preowned game as new, it was a listing error, the price deserved to be preowned so didn't dispute it...that and I wanted to play it too badly lol
  • Poor show from Very, not even bothering to read the post correctly and thus giving irrelevant advice.

If thats the level of service offered in a public domain, I dare not think what it would be like in a more private capacity suchas email or telephone support! I imagine pre-written responses, probably wrong ones at that :)

I notice that the Very representative has gone quiet after giving a stock answer without even bothering to read the post.

Or it could be that being that they weren't in work yesterday - as it a) a Saturday and b) New Year's Eve

I would be inclined to agree with you if it were not for the information displayed within their public profile - it clearly states their last activity on this site was Sunday 1st January at 6:55pm

So it appears news years eve/day or weekend are of little relevance - they were active on the site and 'could' have replied......

  • Nicola,

You seem to have forgotten to reply to the point asking why you gave totally incorrect and misleading information in your earlier post.
