Apple sent me the wrong thing

I ordered an refurbished Apple Ipod touch 32g with camera they delivered one without a camera. I have contacted Apple and they say they are willing to exchange it but dont have any in stock so they say I have to return my ipod, get a refund, wait for one with a camera to come avalible then purchase it and once i have it they will offer me a good will gesture. Thing is that could mean a long wait, they say the deadline to return my ipod is January the 9th, i dont want a refund or a good will gesture i just want what i ordered. Does anyone know what my rights in this situation are ?

    You have a right to be put back into the position you were in before you placed the order.

    ie to return the product at their cost and to receive a full refund.

    They have admitted sending you the wrong item, but if they don't actually have the right item in stock, what else are you expecting them to do?

    They have offered a future discount, which is more than you are entitled to.

    Are you hoping someone will respond and tell you that Apple should of course immediately send you a brand new one? It's nice to dream

  • I'm in the same situation as you, except it's a different store. Asked for 2nd gen, got 1st gen. They admitted their error, but have no others in stock. I've given them a week to get one, then I'll get a refund. It's not their fault that they don't have any.
    One important thing to remember is that when you get to the end of this sentence, you'll realise it's just my sig.

    Unless Apple have the technology to magically create one out of thin air, you'll probably have to wait. Or, in that time, you might find another good deal on an iPod elsewhere - even better!
