Fault/Non fault accidents - are insurance cos cheating?

I was involved in an accident where a lorry hit my car and failed to stop. The number plate on it was false so my insurers cannot claim against the third party. The accident was independently witnessed and my insurers appear to accept that it was not my fault. They have, nevertheless, declared it as a 'fault accident' when it came to renewal, so my premiums have rocketed. Does anyone know what comeback I have and how I challenge this?

    On the facts presented, none.

    A "fault claim" is any claim where the insurer cannot recover its outlay from a third party - regardless of "fault" in the sense of "blame".

    Isn't there supposed to be a fund to cover uninsured drivers (as was the case with the lorry)?

    yep, it's called the MIB but for them to pay either the driver or the vehicle must be identified.

    also, you must go direct to the MIB, you can't claim off your own insurance and then reclaim the costs from the MIB
