Failed ESA Medical. Advice Please.

I have just recieved a phone call from DWP telling me I have failed my ESA medical. I was told to apply for JSA. I said I wanted to appeal. I was told my last IB payment would be 17th Jan. I was also told I would have to send a sick certificate to cover me from 18th Jan onwards. What do I do now? When should I ask my dr for a sick certificate? Now? Or nearer the 18th? Bearing in mind it is still Dec. If I ask for it now, will it be dated from now or the 18th Jan? Sorry to ramble, but I am freaked out by what I need to do. I was told a notification letter would be sent out today, but might be held up due to Christmas post etc.

I forgot to add I asked for an appeal letter and a copy of my report.

You need a sicknote from the date of the decision that you were not entitled to ESA, ideally.
You should phone up again, and ask for a 'statement of reasons' - this will give a fuller explanation of why you are not entitled.
http://www.dwp.gov.uk/docs/m-06-11.pdf - this is a list of the current descriptors that you need to get points against, understand it, and work out what you should have scored.

Then you need to send an appeal letter - describing why you want to appeal, and what you are appealing.
After this, your payments will continue at the reduced 'assessment' rate of ESA.

So I need a sick note from now? The lady that called me said I needed it from 18th jan, as my last payment is 17th? And is my statement of reasons my medical report that I have asked for? Sorry to sound so stupid. I just want to get everything right?

Hi....im going through the same process as yourself and whilst you will probably get the correct advice here what I have done is enlist the help of a welfare rights officer. They will advise you on every step you need to take and work on your behalf to make sure you are doing what you should be doing. Its an absolute minefield and I wouldn't like to go it alone at all.

If you live in an area that still has welfare rights officers ...
