Esatate Agents disclosures when selling

Hi,

was wondering if anyone can help, legally what do estate agents have to disclose to buyers when selling a property???

I'm looking to buy a house that is on the market for approx 118k, I know that it's been on the market at about this price for 6 months with agent No 1. However when I directly asked when it went on the market, they got very defensive, and just said that it's been very slow in November and December.

speaking to agent no 2 in the same town and on the same road, however has been very open and honest and has said to me that anything below stamp duty in good condition is flying out of their office. Looking at the number of sales on right move they seem to be correct.

I'm looking at another house with agent no 1 this week, and they called up to say the tenant would be carrying out the viewing!!! I didn't even know it was tenanted?

So what should they disclose and what questions should I be asking.

  • The estate agent doesn't have to disclose anything to you (the buyer) - they are working for the vendor not for you.

    Basically, you have no rights to any information.

    Of course, this type of negativity would not enable the property sale to work, so agents will provide details, but they can withhold anything they like about the property providing that they don't MISLEAD you.

    Any information that the agent *is* prepared to provide you must be accurate - however, they don't have to inform you of anything negative that they are aware of about the property - it is up to you to find out.

    Don't bother asking an EA anything, especially if you don't have witnesses ;)

    (And yes - used to work for an EA!)
    Don't see the point anymore in offering advice to people who only want to be agreed with...
